Arizona gubernatorial candidate Kari Lake to formally declare invasion on southern border to address drug problem, illegal immigration

U.S. border officials recently made substantial drug busts in Arizona that seized thousands of deadly fentanyl pills that appeared to have been disguised to look like candy, suggesting the criminal drug cartels in Mexico are targeting children with their dangerous and illicit products.

That seizure of “candy-like” fentanyl pills at the border spurred Arizona gubernatorial nominee Kari Lake to reemphasize her plan to formally declare an “invasion” at the southern border and make full use of any additional powers such a declaration would authorize, Fox News reported.

Lake to issue a formal declaration of invasion of the southern border

“This is the biggest invasion we’ve ever had on our homeland since the founding of this country. And so we’re going to call it what it is,” Lake told Fox News in an interview.

“It’s also important to call it what it is for our policy as well. We’re going to be invoking our inherent powers under Article I, Section 10 of the U.S. Constitution to defend ourselves from the invasion in lieu of the federal government reneging on their guarantees to protect us under the Guarantee Clause, Article IV, Section IV,” she continued.

Lake added, “So we will issue a declaration of invasion, and we will take on those powers that are granted to us in the U.S. Constitution, and we will take care of the problem at our border.”

Constitutional basis for invasion declaration

Lake referenced two distinct provisions of the U.S. Constitution that are applicable to the situation, the first being Article IV, Section 4, which states, “The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion; and on application of the legislature, or of the executive (when the legislature cannot be convened) against domestic violence.”

Lake also seeks to invoke the third clause of Article I, Section 10, which states, “No state shall, without the consent of Congress, lay any duty of tonnage, keep troops, or ships of war in time of peace, enter into any agreement or compact with another state, or with a foreign power, or engage in war, unless actually invaded, or in such imminent danger as will not admit of delay.”

Her moves would be in line with a growing theory that posits that since the federal government has failed to fully protect states like Arizona from an “invasion” of its southern border, the state, therefore, is being “actually invaded” and faces “imminent danger” such that it is permitted to enter into compacts with other states and “engage in war” to defend itself.

Other plans to enforce border security and immigration laws

Formally declaring an invasion is only one part of Lake’s policy plans for the border if elected, as her campaign website lays out several other proposals, including forming a compact with “like-minded states” on border security to act in the absence of the federal government to defend the southern border and enforce immigration laws.

She would also work to finish the incomplete border wall where possible, strengthen and empower state law enforcement and the National Guard to detain and deport illegal migrants apprehended under criminal trespassing laws, and crack down on the drug cartels through arrests, prosecutions, and asset seizures and forfeitures.

“A lot of people here in Arizona are very concerned with the number of people coming across,” Lake told Fox News. “They’re taking jobs, and they’re driving down wages for our middle class. And there’s been no interest in any leader to do something serious about it and stand up for the people of their state. That’s going to change in January of ’23 when I take office. We’re going to put the needs of our Arizona residents first.”
