President Joe Biden is begging the Supreme Court to let his administration end former President Donald Trump’s “Remain in Mexico” policy, despite an already unsustainable crisis at the southern border.
In a petition filed Wednesday, the Biden administration asked the high court to decide whether he must follow a lower court ruling ordering him to reinstate the signature Trump policy, Fox News reported.
Biden tries to make things worse
The Biden administration has failed in its efforts so far to cancel the policy, formally known as Migrant Protection Protocols (MPP), which requires asylum-seekers arriving at the southern border to wait in Mexico while their claims are considered.
Trump brought the policy to cut down on fraud in the asylum system, but Biden’s top immigration official, Homeland Security Secretary Alejandro Mayorkas, called it inhumane in an October memo, according to Fox, and said it failed to “address the root causes” of illegal immigration.
Many would say that Biden’s agenda is now among the “root causes” driving a historic border surge, of course, but Biden has been dragging his feet with reinstating “Remain in Mexico” after a federal judge found Biden’s efforts to end the policy “arbitrary and capricious” and an appeals court agreed.
In a petition to the Supreme Court, Biden’s officials asked the justices to decide whether the appeals court “erred” when it decided Mayorkas’ memo canceling the policy was invalid.
“In short, the lower courts have commanded [the Department of Homeland Security] to implement and enforce the short-lived and controversial MPP program in perpetuity,” lawyers for the Biden administration wrote, according to Axios.
Border crisis spirals
According to CBS News, Biden has returned just 200 migrants so far under a revised, more liberal form of the policy.
His reluctance to secure the border comes as illegal immigration reached its highest levels on record last fiscal year, with some 1.7 million migrants rushing America’s southern border after Biden took a hatchet to Trump’s immigration agenda.
Biden began canceling Trump’s strict border control policies on Day One, ending construction of the southern border wall along with his action on “Remain in Mexico.”
On Biden’s watch, deportations and immigration arrests have plummeted, sending a clear message to illegal migrants that they will be welcomed with open arms. Biden has even been secretly shuttling migrants into the nation’s interior, according to reports.
