Biden’s nanny state paternalism takes a hit as federal court blocks Juul e-cigarette ban

A federal appeals court has temporarily frozen President Biden’s ban on the popular e-cigarette Juul, in a setback to Biden’s war on tobacco and nicotine products.

The FDA had issued an edict last week demanding that Juul stop selling its vape products, a move that the company condemned as “extraordinary and unlawful.”

Court freezes Biden’s Juul ban

The U.S. Court of Appeals for the D.C. Circuit granted the company’s emergency request Friday to put the ban on hold as Juul appeals the restriction, CBS reported.

The Biden administration is demanding that e-cigarette makers prove their products are beneficial for “public health,” which means showing adults who use them are likely to quit smoking and that young people aren’t likely to get addicted, CBS reported.

The FDA says Juul’s data is “conflicting” at best and that the company hasn’t proven its products are safe, citing concerns with potentially harmful chemicals, the Washington Post reported.

A leading e-cigarette maker, Juul has been accused of targeting young people with its trendy vape pens.

The company previously removed sweet, fruity flavors from the market in 2019 after an uproar.

Biden’s incessant busybodyism

Juul said the FDA’s ban is arbitrary because the company was allowed to sell its products while under review, and the FDA has approved e-cigarettes from some of Juul’s competitors like R.J. Reynolds and Logic, CBS reported. The company blasted Biden’s move as politically motivated.

“If the court does not intervene, [Juul Labs] products will disappear from store shelves and politics will have won over sound science and evidence,” the company said in a court filing.

Biden’s FDA is also seeking to lower the amount of nicotine allowed in cigarettes as part of an anti-tobacco campaign.

Burdening a vape company with proving its products are “healthy” seems like a bit of an arbitrary and impossible standard. Should McDonald’s have to prove that Big Macs are “beneficial to the public health” to keep selling burgers?  Where does the nanny state paternalism end?

Of course, Biden has also bullied people into taking vaccines against their will just to keep their jobs. Why doesn’t Biden mind his own business and let adults make decisions about their own health? Biden brings moral busybodyism to a whole new level.
