Even as they insist that the unprecedented, draconian FBI raid on President Trump’s Mar-A-Lago home is just proof that “no one is above the law,” over-excited Democrats just can’t help sharing their true motives.
As Fox News reported, none other than Clinton campaign lawyer Marc Elias alerted his followers to the real significance of the raid: the possibility that it could lead to Trump’s disqualification from office in 2024.
Clinton lawyer shares theory for barring Trump from office
The official pretext of the raid, which the Biden White House claims took them by surprise, is that Trump violated laws on record-keeping.
Elias, who worked on Clinton’s scandal-plagued 2016 presidential campaign, pointed to a statute in the U.S. Code that makes it a crime to conceal, remove, or destroy government records. Those convicted are “disqualified from holding any office under the United States.”
Ironically enough, the statute that Elias cited came up during the 2016 election in reference to Clinton’s handling of classified e-mails. Elias has a conveniently short-term memory, it seems.
Legal experts have poked holes in Elias’ theory, noting that the Constitution, not Congress, sets qualifications for office. Elias conceded that point, but he took care to spell out for Democrats how they could still hobble a Trump 2024 bid: legal harassment.
“The idea that a candidate would have to litigate this is during a campaign is in my view a ‘blockbuster in American politics,’” he wrote.
Democrats gloat, but did they miscalculate?
While Democrats clearly hope the raid will somehow kneecap any chance of Trump coming back to power, their gloating could prove to be premature.
Democrats impeached Trump twice, but they failed both times to secure the Senate conviction that would have been necessary to disqualify him from office.
There is already speculation that the Mar-A-Lago raid will backfire and boost Trump, whose political brand is based on a perception that he is an “outsider” to a corrupt Washington establishment that protects well-connected politicians like Hillary Clinton.
While Democrats have defended the raid by resorting to a slogan — “no one is above the law” — Republicans have noted that Clinton was never prosecuted for her mishandling of classified e-mails and that the FBI has a history of anti-Trump misconduct. Most notoriously, the FBI spied on Trump’s presidential campaign using specious FISA warrants.
Trump has cited the raid as more evidence that the “Deep State” is out to get him and his supporters as the GOP rallies around the former president. Even anti-Trump “RINOs” like Mitch McConnell (R-Ky.), and Democrat Andrew Cuomo, of all people, have expressed concern that the DOJ overstepped.
