Complaint filed with FEC over Biden failure to officially declare 2024 candidacy

A big question ahead of 2024 is whether President Joe Biden will run for a second term — something the president has repeatedly and strongly hinted at but has not made official with the Federal Elections Commission.

The president’s hand may soon be forced on the matter, though, as a conservative anti-Biden PAC has filed a formal complaint with the FEC asserting that Biden is, in fact, a candidate for 2024 and should file the required paperwork denoting such, the Conservative Brief reported.

The attorney leading that effort, Dan Backer, is the same one who recently won a victory over failed 2016 nominee Hillary Clinton when he convinced the FEC to fine the Clinton campaign $113,000 for falsely reporting as legal expenses the funds that were used by the campaign law firm Perkins Coie to pay for the maliciously fraudulent anti-Trump Steele dossier.

Biden has not updated FEC records on his 2024 candidacy

PJ Media first reported in October 2021 that Backer’s anti-Biden PAC, the Committee to Defeat the President, had filed an initial complaint with the FEC over the 2024 candidacy status of President Biden, the Biden for President campaign, and its associated fundraising arm, the Biden Victory Fund.

The complaint argued that Biden’s statements about running again in 2024 signified that he met the definition of a candidate, as did the fact that he or his designee, the Biden Victory Fund, had raised and/or spent more than $5,000.

Except, neither Biden nor the campaign nor the fundraising committee has updated their status with the FEC with regard to 2024 candidacy, as should have already happened, and if that continues to be the case, then nearly $2 million in funds raised by the committee will have been impermissible and illegal.

The FEC was reported to have opened an official investigation into the matter, but nothing more has been heard about it … until now.

Evidence grows that Biden will seek a second term

PJ Media has now reported that Backer’s group has filed an amended complaint and sent a letter to the FEC offering up even more evidence that President Biden is running for a second term in 2024 and, therefore, must appropriately update his status as a candidate with the federal regulatory body.

That letter largely reiterated the facts of the initial complaint but added to the record a recent article from the left-leaning New York Magazine’s Intelligencer that surveyed the 2024 outlook for the Democratic Party and whether Biden would run again or, if not, who might be capable of stepping up to be the party’s nominee.

The article included numerous quotes from Biden himself as well as top aides and donors that all strongly indicated that the president was definitely in the running for a second term in the White House.

Biden is running and he must make it official

“Any talk of Biden not running in 2024 is Democrat wishful thinking,” Backer told PJ Media. “In short of something awful happening, Biden is the nominee in 2024. He has spent 50 years ruining the country and eyeing this job. He will not exit the race voluntarily.”

“It is outrageous Biden is refusing to comply with federal law,” he added with regard to the required FEC filings. “And once again, the FEC seems content to sit back and do nothing.”
