Congressional Democrats are looking to disqualify former President Donald Trump from making his 2024 presidential campaign as polling numbers begin to rise.
According to Breitbart News, the polling for Trump has seen a resurgence as the 2024 election cycle looms and it’s assumed that the former president will attempt to run for office again and a dozen Democrats are recoiling at the idea, according to The Hill.
Included in the group who are attempting to strip the former president of eligibility to run again are y Rep. Jamie Raskin (D-MD), Rep. Jerry Nadler (D-NY), Rep. Debbie Wasserman Schultz (D-FL), and Rep. Steve Cohen (D-TN).
The plan is being enacted as the lawmakers attempt to use Section 3 of the 14 Amendment, which states:
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President… who, having previously taken an oath… shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”
This reliance is, of course, dependent on the term “insurrection or rebellion,” with the idea that if the president can be firmly tied to the Jan. 6 2021 Capitol Hill riots, and those riots can be called an insurrection, it would ban him from seeking office again.
According to one Harvard Law School constitutional expert, Laurence Tribe, the suit being brought would keep Trumps’s name off the ballots and it “would “stand a good chance of success,” he said.
Tribe said, according to The Hill, that if suits about the eligibility of the former president were to be put to the test of litigation, it would probably be denied on a “neutral fact-finder setup by Congress.”
That group would be tasked with determining what Trump’s role in the Jan. 6 demonstration was, and whether it rose to the level of triggering the Section 3 of the 14th Amendment, should the event be named an insurrection.
At this point, despite their efforts to put the blame on the president, the disqualification would require evidence that he committed either an “insurrection or rebellion,” something that Democrats have been unable to do up to this point.
“Democrats’ effort to disqualify Trump from mounting a 2024 campaign comes as the former president is surging in the polls,” Breitbart reported. “A December Center for American Greatness poll revealed Trump is leading Biden by eight percentage points (49-41 percent).”
When those being polled were asked about who Republicans would likely vote for in the 2024 primary Trump lead the pack with points, which seemed conservative, considering that a USA Today/Suffolk University poll released on Tuesday indicated that 58% of Republicans say Biden wasn’t legitimately elected.
