Democrats are calling for Supreme Court Justice Stephen Breyer to step aside and allow himself to be replaced while a Democrat holds the White House, according to CNN.
The 82-year-old justice has served more than two and a half decades on the nation’s high court, and according to some, needs to allow someone to take his seat that has the potential to keep his liberal legacy alive.
Currently, stepping down would allow for an essentially Democratic-controlled Senate to replace the octogenarian before the 2022 elections.
While the Senate is 50-50 at this point, since any tie would be broken by the vice president, who is also a Democrat, it’s not difficult to see how the confirmation process would go well for a liberal candidate.
There’s also the consideration that a margin this close means the upper chamber of Congress could switch to Republican control very easily in the upcoming election.
Rep. Mondaire Jones (D-NY) said Friday that he believes Breyer should retire this summer allowing someone younger to take his place:
“There’s no question that Justice Breyer, for whom I have great respect, should retire at the end of this term,” the New York Democrat said in an interview according to CNN.
Questions about the responsibility of Supreme Court justices have sprung anew since the late Justice Ruth Badder Ginsburg, a staunch liberal, was replaced by the conservative Amy Coney Barrett under the Trump administration.
While many defended Ginsburg’s decision at the time, she was also called on to step down while former President Barack Obama and his Democratic Senate could have installed her replacement.
The Supreme Court’s makeup is again a hot topic in light of the nation’s high court taking up key abortion case that could overturn Roe v. Wade if the decision lands in favor of the unborn.
Conservatives hope the potentially landmark case will be a 6-3 vote, something that is possible given the aggressively pro-life nature of the conservative judges on the panel.
The Washington Post‘s Aaron Blake delved into the issue in his report, saying that this, once again, has brought Democrats to the notion that packing the Supreme Court could be their only salvation from the slew of conservatives topping the nation’s judicial branch.
