Gov. DeSantis promises lawsuit against Biden’s vaccine mandate for private businesses

Fox News reports that Florida Gov. Ron DeSantis (R) is threatening to take President Joe Biden to court over his recent COVID-19 vaccine mandate announcement, which many believe is unconstitutional. 

What’s more, DeSantis appears confident that if such a legal battle takes place, he’ll win.


DeSantis’s latest comments came during a press conference that he held last week in Fort Myers, Florida. There, the subject was the success of monoclonal antibody treatments for COVID-19, which DeSantis has attempted to make available for more residents of the state.

However, during the press conference, DeSantis was asked about Biden’s COVID-19 vaccine mandate. In response, DeSantis revealed that Florida plans to bring a lawsuit against the Biden administration “immediately” upon the mandate being enacted.

“We think the state of Florida has standing to do it,” DeSantis said. “We also know businesses that we’re going to work with to contest it.”

DeSantis explained that in his opinion, Florida has “a responsibility at the state level to do whatever we need to do to protect Floridians from mandates that could result in them losing their jobs.”

The Republican governor added that he believes Biden’s “mandate is going to lose in court.”

Biden’s mandate

The Florida governor was referring to a recent mandate that Biden announced roughly a month ago, which requires businesses with more than 100 employees to either force their employees to get vaccinated or to undergo weekly COVID-19 testing.

Thus far, the Occupational Safety and Health Administration (OSHA) has yet to put forth the emergency rule promised by Biden, presumably due to the impossibly large mountain of legalities involved in such an unprecedented order.

DeSantis, perhaps more than anything else, has skyrocketed in popularity mostly due to his handling of the COVID-19 pandemic, perfectly balancing safety and the personal freedoms afforded to residents of his state. He has steadfastly refused to implement the sort of strict “lockdowns and mandates” approach favored by Democrats.

For example, DeSantis barred local mask mandates in Florida, and he has also worked tirelessly to keep vaccine mandates far away from his state.

Only time will tell if Biden’s mandate takes effect, but if and when that happens, there are a growing number of red-state governors preparing their legal challenges.
