Appeals court shoots down Biden’s latest effort to nix ‘Remain in Mexico’

President Joe Biden’s open-borders policies hit a rare snag this week when a federal court ordered his administration to begin enforcing the law.

The Fifth Circuit Court of Appeals shot down the latest effort by Biden officials to end Donald Trump’s “Remain in Mexico” policy, the New York Post reported.

Federal judge shoots Biden down

According to CBS News, a panel of the Fifth Appeals court found that Biden’s decision to end the program was “arbitrary and capricious” and violated administrative and immigration law.

The scalding opinion was authored by Judge Andrew Oldham, a President Trump appointee, and came after a lower court previously ordered Biden to bring the policy back.

“DHS claims the power to implement a massive policy reversal — affecting billions of dollars and countless people — simply by typing out a new Word document and posting it on the internet,” Oldham wrote in his opinion, according to the New York Post.

The Biden administration “has come nowhere close to shouldering its heavy burden to show that it can make law in a vacuum,” he added.

“Remain in Mexico” was one of Trump’s signature efforts to address asylum fraud. Biden moved immediately to end it upon assuming the presidency, along with the rest of Trump’s common sense border policies.

Biden admin seeks to inflame border crisis

The Biden administration has returned small numbers of migrants to Mexico since bringing back the policy last week in less strict form, with new exemptions for gay and transgender individuals and others considered too “vulnerable” to be sent back.

The open borders lobby was irate with the latest court ruling, with one activist saying Judge Oldham demonstrated “sheer contempt” for the Biden White House in his decision, as The Hill reported. Some would argue that Biden has shown contempt for Americans and the rule of law with his policies, however.

Biden has done seemingly everything in his power to make illegal immigration as convenient as possible, from curtailing enforcement to canceling Trump’s border wall. As a result, the number of migrants seeking to enter the country illegally has soared to a record 1.6 million, the Wall Street Journal reports.

Rates remain high, with a reported 173,000 border arrests in November alone.

Despite unleashing the worst immigrant crisis in American history, the Biden administration seems determined to exacerbate the problem. Frankly, it shouldn’t take a judge’s intervention to ensure the president is executing the laws.
