Federal judge orders Trump’s Title 42 immigration policy to remain in place

A federal judge has just stopped President Joe Biden from ending former President Donald Trump’s Title 42 immigration policy, the Daily Caller reports

Title 42 is the policy that the federal government has been using to expel illegal immigration from the United States during the COVID-19 pandemic.

The Biden administration, in line with its open-border approach to immigration, has been looking to put an end to the policy. The policy, in fact, was supposed to come to an end on Monday.

However, a group of Republican attorneys general has worked to prvent Biden from proceeding with his plan.

The ruling

Judge Robert Summerhays, in a decision that he released on Friday, granted the request of the Republican attorneys general to temporarily stop Biden from ending Title 42, while litigation continues.

“The Court agrees with the Plaintiff States that a nation-wide injunction is necessary for complete relief given the ability of immigrants crossing the border to move freely from one state to another,” Summerhays wrote.

An appeal is forthcoming

It is now expected that the Biden administration will appeal this decision. Biden’s Department of Justice indicated as much in a statement responding to Summerhays’s decision.

The department wrote:

The Centers for Disease Control and Prevention (CDC) invoked its authority under Title 42 due to the unprecedented public-health dangers caused by the COVID-19 pandemic. CDC has now determined, in its expert opinion, that continued reliance on this authority is no longer warranted in light of the current public-health circumstances. That decision was a lawful exercise of CDC’s authority.

Karine Jean-Pierre, the new White House press secretary, also released a statement, saying:

The Administration disagrees with the court’s ruling, and the Department of Justice has announced that it will appeal this decision. The authority to set public health policy nationally should rest with the Centers for Disease Control, not with a single district court.

Looking ahead

We have already seen record or near-record illegal immigration with the Biden administration in charge. It is expected that the situation will worsen if Title 42 is formally terminated.

The Biden administration, in fact, is predicting that daily border crossings would jump from about 8,000 per day to 18,000 per day.

This is one of the reasons why Republicans are fighting so hard to keep Title 42 in place.
