Florida AG sues Biden admin over orders restricting deportation of criminal aliens

Republican Florida Gov. Ron DeSantis has become a respected leader in his party over the course of his response to the ongoing COVID-19 pandemic.

He has also gained GOP recognition for his resistance to President Joe Biden’s agenda — including through his state’s lawsuit against the White House for its refusal to detain or deport many undocumented immigrants.

“Refusing to do their jobs”

The Biden administration has attracted mixed reviews for the order, which would even restrict the deportation of individuals previously convicted of or charged with serious crimes.

For their part, Florida officials are taking issue with two guidance memos detailing the White House’s plans to bypass enforcement of various immigration laws.

According to the Washington Examiner, the first memo originated from the Department of Homeland Security on Jan. 20, followed by another that came from the head of Immigration and Customs Enforcement nearly a month later.

Florida Attorney General Ashley Moody explained the state’s position in a statement, asserting: “The Biden administration’s reckless policy of refusing to do their jobs and deport criminals, places all those gains and Floiridans’ public safety at risk.”

She added that “presidents of both parties detained and deported criminals” prior to Biden’s inauguration.

“This is a radical shift that places Floridians and our law enforcement officers in greater danger, and that is why I filed suit,” Moody concluded.

“A public-safety nightmare”

Bolstering the state’s case that the Biden administration is refusing to detain or deport criminal aliens, officials submitted a collection of emails received from various ICE officials informing Florida Department of Corrections Correctional Service Administrator Kimberly Thomas that the agency would not be taking custody of certain individuals due to “current interim enforcement guidelines.”

Moody filed a formal complaint in federal court on Monday, writing that Biden and his administration “violated their oaths of office, flouted Congressional statutes, failed to protect U.S. citizens and immigrants alike, and created what will quickly become a public-safety nightmare” without hours of the president’s inauguration.

As a result of what she called an “abdication of duty,” she insisted that the result of the federal orders will be to “allow criminal aliens to be released into and move freely in the State of Florida, and their resulting crime will cost the State millions of dollars on law enforcement, incarceration, and crime victim’s assistance.”

DeSantis has been a vocal opponent of Biden’s immigration agenda, describing the president’s positions as “terrible policy” and “entirely reckless,” which reports depict as a clear sign of support for the attorney general’s current action in court.

  3. Wonder why the news media, except Fox, doesn’t report on the obvious blunders, intentionally by Biden and the administration. He should be talking and doing something about it, instead of telling the world, like Cuomo, how wonderful he is. Less mouth, more action.

    1. Totally agree. In addition, the impeachment of the Dot-head/Jamaican (Cumala) for encouraging rioting last summer as well as getting rioters out of jail. The Republicans are asleep at the wheel, as usual.

  9. Its a wonder charges of Human Trafficking and Child Endangerment haven’t been filed against Biden given the increased numbers his reversal of Policies has created. Maybe that is exactly what China wants

  10. Thank God for governors like Florida and Texas has. They have the guts and good sense to say “NO” to idiot Biden’s stupid, illegal, dangerous orders to just open the doors to ILLEGAL ALIENS and all of the crime and costs involved. Putting LEGAL USA CITIZENS @ risk for disease, crime, etc. Wish more Governors had as much courage to step up and just say “NO”.
