GOP senators vow to withhold votes on funding measure if no money is allotted for border wall construction

President Joe Biden and his administration have abdicated its duty to properly secure the nation’s southern U.S. border, including by halting all ongoing and future border wall construction projects, and repurposing the designated funds — a move supported by congressional Democrats.

But Biden’s refusal to secure the border has been met with an ultimatum by a group of Republican senators: restore funding and resume construction of the border wall or else their potentially crucial votes will be withheld from an omnibus bill funding the government for the current fiscal year, Fox News reported.

That group of Republicans includes Sens. Mike Braun (IN), Ted Cruz (TX), Mike Lee (UT), Cynthia Lummis (WY), and Marco Rubio (FL), and the media outlet exclusively obtained a letter they intend to distribute next week to their GOP colleagues explaining their position.

Do it, or else

The GOP senators took great exception to Senate Appropriations Committee funding proposals that “fail to provide America’s border agents with the proper security infrastructure necessary to defend America’s southern border from the continued crisis of unrestrained illegal migration.”

“The failure to provide sufficient resources is a continuation of the Biden-Harris Administration’s inability and unwillingness to acknowledge the humanitarian and national security risks created by its open-border policies,” the letter continued. “We write to indicate that we will withhold support of any negotiated Fiscal Year 2022 omnibus funding agreement that fails to appropriately fund our nation’s border security.”

Specifically at issue for the group of GOP senators are provisions within the Homeland Security bill portion of the omnibus spending package, which shifts previously allotted border wall construction funding to other areas along with reducing funding overall for Customs and Border Protection (CBP), as well as Immigration and Customs Enforcement (ICE).

“Significant evidence”

The senators also pointed to one particular earmark that would dedicate $50 million in federal funding to begin the process of tearing down already completed portions of the border wall constructed during former President Donald Trump’s tenure in office.

That is being done in spite of “significant evidence,” the senators claim, that the border wall is a “critical tool for America’s border security agents to combat illegal migration, drug smuggling, and human trafficking.”

“The continuation of border security funding, particularly continued funding for physical barrier construction, remains necessary during the continued immigration crisis,” the Republicans wrote. “As such, and in the defense of our nation, we will not offer support for any fiscal year 2022 omnibus agreement that omits this funding or authorizes the administration to remove previously constructed border security measures.”

Lawsuits filed

Meanwhile, Fox News reported separately that the Republican-led states of Missouri and Texas have filed a lawsuit against the Biden administration over its own actions to shift previously appropriated funding specifically for border wall construction to other projects, which the states assert is a violation of the Constitution and separation of powers.

Those states are seeking a preliminary injunction and ultimate ruling from the federal courts that would require the Biden administration to resume construction of the border wall with the funding that had already been appropriated by Congress.

Notably, those two states already secured a legal victory against the administration in a lawsuit that resulted in an order for Biden to reimplement the Migrant Protection Protocols, known as the “Remain in Mexico” policy from the Trump era, which required asylum seekers to wait in Mexico while their claims are adjudicated.
