Judge blocks Biden’s vaccine mandate for head start teachers

A federal judge blocked President Joe Biden’s COVID-19 vaccine mandate on Saturday for workers in the federal Head Start early education program in a preliminary injunction.

U.S. District Judge Terry A. Doughty also ruled against the mandate that students two years old and older must wear masks indoors at Head Start programs.

The important ruling was brought to the court by leaders in 24 states.

The ruling applies to Alabama, Alaska, Arizona, Arkansas, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, Wyoming and West Virginia.

The Ruling

“If the executive branch is allowed to usurp the power of the legislative branch to make laws, then this country is no longer a democracy — it is a monarchy,” Doughty wrote.

“Could the secretary mandate all children in the Head Start Program be vaccinated? Could the secretary mandate the parents and siblings of children in Head Start to take the COVID-19 vaccines? These examples may seem far-fetched, but so did the idea that vaccines could be mandated to millions of United States citizens,” he added.

The Response

“This victory will help ensure that numerous Head Start programs will continue to operate rather than have to fire teachers and cut back services to children,” Alabama Attorney General Marshall said in a news release, according to the Associated Press.

“And this win will forestall the nonsensical and damaging practice of forcing masks on two-year-olds,” he added.

The vaccine mandate ruling is one of many legal challenges facing the Biden administration in recent weeks.

Additional legal challenges may push the matter to the Supreme Court, leading to the nation’s highest court deciding how far executive power can extend in enforcing mandates.
