Judge hands Larry Elder massive victory, says he can enter California governor’s race

Earlier this month, attorney and conservative media legend Larry Elder made headlines after announcing his intention to run for governor of California, given the current recall effort that Gov. Gavin Newsom (D) faces.

However, Elder was recently informed by state election officials that he is not eligible to enter the race. Elder challenged the ruling in court and a judge just ruled in his favor, Politico reported

As The Daily Wire previously reported, Elder broke the news that he would be excluded from the race in a series of tweets on Monday, declaring, “We’re in court in less than an hour over this B.S.”

“Before we submitted the over 200 pages of 5 yrs of tax returns, my accountant made sure we complied with the law, as did two election law lawyers,” Elder continued.

Elder caught on technicality

“This new law was passed by the supermajority Democrat legislature to force Trump to turn over his tax returns to get on the 2020 ballot,” Elder explained, referring to a law that was originally passed to target former President Donald Trump.

“The California Supreme Court struck it down unanimously for presidential, but let it stand for gubernatorial elections. See you in court,” Elder added.

Elder included an image of the letter from the office of California’s secretary of state that alleged he failed to provide required tax documents in order to qualify as a candidate.

“Dear Candidate,” the letter began, “We are writing to inform you that you did not qualify as a candidate for the upcoming September 14, 2021, California Gubernatorial Recall Election.”

Elder sued and won

“According to our records, you did not qualify due to one or more of the following reasons,” the letter went on, showing a checkmark next to the sentence, “Incomplete redacted and/or unredacted income tax returns were filed.”

Elder followed up with another tweet on Tuesday that read, “I’ve filed a lawsuit against CA Sec. State Shirley Weber to compel her office to place me on the ballot. I’ve complied with everything the law requires of me to run in this recall election against Gavin Newsom. Learn more and read the suit at my website.”

Conservative YouTube personality Dave Rubin tweeted his support for Elder, accusing California’s “deeply corrupt” political establishment of targeting him because he poses “a real threat” to Newsom.

On Wednesday afternoon, Fox 40 reported that a Sacramento County judge sided with Elder and ordered that his name appears on the upcoming ballot, marking an impressive and swift legal victory to rightfully run for office after complying with all applicable requirements and laws.
