Judge orders Twitter to share data about bots with Elon Musk

A judge has ordered Twitter to share data with billionaire Elon Musk about how many bots it has on its platform.

Chancellor Kathaleen McCormick of Delaware’s Court of Chancery dismissed Musk’s request for data as “absurdly broad” but nevertheless found that some further data disclosure is “warranted,” Reuters reported.

Musk announced a bid earlier this year to buy Twitter and democratize the platform by removing speech controls that target conservatives.

He later backed out in July, saying Twitter was not being transparent about how many genuine users are on its platform. Musk alleges that up to 30 percent of Twitter’s “monetizable daily active users” are fake.

McCormick found that the “tremendous amount of information” Twitter has already agreed to produce is “sufficiently broad to satisfy most” of the company’s legal obligations.

But the judge called on Twitter to share a “historical snapshot” of its user base by sharing data for about 9,000 accounts that were part of a quarterly audit.

“Plaintiff is ordered to produce a subset of what Defendants have requested: the 9,000 accounts reviewed in connection with Plaintiff’s Q4 2021 audit, which the parties refer to as the ‘historical snapshot,'” the judge wrote.

Musk responds

The judge asked Twitter to produce the data “subset” within two weeks if possible.

But McCormick also said that “no one in their right mind has ever tried to undertake” Musk’s request for Twitter to pull trillions of data points.

Twitter has sued Musk to force him to go through with the $44 billion deal. Although Musk wants to walk away, he is seeking to test Twitter’s claim that only 5 percent of users are phony.

“We look forward to reviewing the data Twitter has been hiding for many months,” Musk’s attorney, Alex Spiro, said.

A five-day trial has been scheduled for October 17.
