Judge upholds DeSantis’ ban on mask mandates in Florida schools

A Florida judge has upheld GOP Gov. Ron DeSantis’ ban on mask mandates in schools in a victory for parents and a defeat for mask-crazed Democrats and petty tyrants on local school boards.

In a decision Friday, Judge Brian Newman found that the school boards challenging the rule “failed to prove” that letting parents opt out of mask mandates spreads COVID-19, the Washington Examiner reported.

“The rule is lawful”

Governor DeSantis reportedly started docking the pay of school board members that impose mask mandates in October, and he has withheld funding from two counties.

According to the Examiner, Judge Newman argued that the policy strikes “the right balance” and that Alachua, Broward, Duval, Miami-Dade, Orange, and Leon counties failed to provide a reasonable argument against it.

“On the contrary, the evidence admitted in this case established that the emergency rule opt-out provisions strike the right balance by ensuring that the protocols that govern the control of COVID-19 in schools go no further than what is required to keep children safe and in school,” Judge Newman said.

DeSantis press secretary Christina Pushaw hailed the decision, which she noted is the first to rule on the merits.

“As we expected, the court affirmed that the rule is lawful. Any school board politician in Florida who persists in defying the law and infringing upon parents’ rights will face consequences,” she said in a statement.

Victory for parents’ rights

The judge noted that Leon County recently began letting kids go to school unmasked, which he called an “indication that such policies are safe.”

“The emergency rule requires sick children to stay home,” the judge said. “It is extremely rare for asymptomatic people to spread COVID-19 and children are otherwise inefficient transmitters of the…virus.”

Despite the trivial risk that COVID-19 is believed to pose to children, the Biden administration has sided with the school boards against parents, reimbursing school boards penalized by DeSantis, according to ABC News.

Meanwhile, DeSantis has become a lightning rod of liberal rage for his opposition to mask and vaccine mandates, which continue to be litigated in courts all over the country.

According to the Examiner, he has joined with other Republican governors in suing over Biden’s draconian vaccine mandate for private companies with more than 100 workers. The authoritarian mandate was recently frozen by the 5th Circuit Court of Appeals, which cited “grave statutory and constitutional” concerns, according to Reuters.
