The Biden administration is finally getting sued over its tyrannical and deeply unfair student loan forgiveness patronage scheme.
A libertarian group, the Pacific Legal Foundation, filed a lawsuit Tuesday against Biden’s unilateral decree, calling it “flagrantly illegal.”
Biden sued over student loan forgiveness
The plaintiff, public interest lawyer Frank Garrison, is one of 8 million people who can expect to receive automatic loan forgiveness from Biden’s plan.
But Garrison doesn’t want his loans forgiven by Biden, as it would force him to pay a state tax in Indiana that he would not otherwise pay under the congressionally authorized Public Service Loan Forgiveness (PSLF) program.
“Mr. Garrison and millions of others similarly situated in the six relevant states will receive no additional benefit from the cancellation — just a one-time additional penalty,” the suit says.
The White House released an angry, defensive statement blasting the lawsuit as “baseless” because “no one will be forced to get debt relief.”
“Why would this group bring this baseless claim? Because opponents of the debt relief plan are trying anything they can to stop this program that will provide needed relief to working families,” the statement said.
Supreme Court case upcoming?
The White House has been on the defensive over the debt jubilee, which the Congressional Budget Office estimates will cost taxpayers $400 billion. Many say it unfairly transfers wealth to college graduates, who disproportionately vote Democrat.
The Pacific Legal Foundation blasted Biden’s move as an “election year ploy,” but they also criticized former President Trump for setting a bad precedent with a nationwide evictions moratorium that Biden later extended before the Supreme Court shut it down.
Could Biden’s student loan scheme wind up at the Supreme Court next? Judicial review is certainly justified. Biden is brazenly trampling on the separation of powers.
Biden’s not really even pretending anymore that what he’s doing is legal. He recently declared that the COVID pandemic is “over,” in effect contradicting his own flimsy pretext for erasing student debt, namely, that the pandemic is still an “emergency.”
It is “flagrantly illegal” for Biden to appropriate huge sums of money via “press release,” Caleb Kruckenberg, an attorney at Pacific Legal Foundation, said. Hopefully, the courts will recognize that soon and put Biden in his place.
