As Democrats press ahead with a court-packing scheme, many Americans are alarmed by what seems to be an attempt to replace a constitutional system of checks and balances with rule by one party. One conservative activist is calling out the power grab in blunt terms.
Tom Fitton, president of the conservative group Judicial Watch, warned that Democrats are trying to “blow up the Constitution” by turning the Supreme Court into a rubber stamp for their most extreme ideas.
Dems: Supreme Court losing legitimacy
Democrats began arguing that the Supreme Court was losing its “legitimacy” during Donald Trump’s presidency as it became more conservative.
Recently, Democrats have changed the definition of “court packing” to advance this argument in a more pointed form: as Rep. Jerry Nadler (D-NY) framed the push, Democrats are “unpacking” the Court, not packing it.
To the contrary, Fitton said it is Democratic Party “extremists” who are threatening to corrupt what is supposed to be an apolitical institution.
Once the Court becomes nakedly political, there’s nothing stopping successive presidents from changing it to suit their agenda, he told Fox News.
“If you had a commission saying, ‘let’s blow up the Constitution,’ people would be nervous. When you talk about packing the Supreme Court, you’re talking about blowing up the Constitution,” he said.
Biden under “extreme” pressure
While Democrats have discussed court packing for some time, the threat grew more tangible recently when Nadler and Sen. Ed Markey (D-MA) introduced legislation to expand the Court last week.
“We can undo the damage that the Republicans have done by restoring balance. And we do it by adding four seats to the court to create a 13-member Supreme Court,” Markey said.
Biden, who refused to clarify where he stood on court-packing during his presidential campaign, has kept things equivocal with a “commission” to “study” the issue, but critics are calling this a political maneuver to provide a patina of legitimacy to what is plainly a power grab.
Fitton said that Biden may be trying to strike a balance between moderate and extreme factions, but his “commission” is a rather thin reed. As Fitton put it, Biden is “playing with fire” and unlikely to withstand “extreme” political pressure from the left.
“The pressure is extreme from the left to blow up the Supreme Court,” Fitton said. “Our Constitution is under attack with this commission, let’s be clear.”
