New York state court throws out Democrat-created congressional map

Earlier this year, New York’s Democratic state legislators drew up a new congressional map that sharply favored their party.

However, Fox News reported on Thursday that a New York state appeals court has found the map to be illegal. 

Judges say the map was created to target “particular candidates or political parties”

Five members of the seven-judge panel agreed that the map was designed “to discourage competition or for the purpose of favoring or disfavoring incumbents or other particular candidates or political parties.”

They went on to point out how the map had been created “without any Republican input” and “was adopted by the legislature without a single Republican vote in favor of it.”

Thursday’s ruling came after a group of GOP voters challenged the new map and a lower court sided with them last month.

Lawyers representing the state Senate and Assembly as well as Gov. Kathy Hochul appealed the ruling, arguing that it is insufficient to come out with a map ahead of this year’s election.

The issue is expected to now be heard by the Court of Appeals, which is New York’s highest court. Arguments may begin to play out within a week.

Jonathan Turley: Courts say Democrats are “trying to rig elections”

Fox News noted that congressional redistricting has been a contentious issue across the county and has resulted in other states seeing their electoral maps challenged in court as well.

That includes maps drawn by Republican lawmakers in North Carolina, Ohio, and Pennsylvania as well as a map created by Democrats in Maryland.

Those challenges have caused delays at the ballot box, with North Carolina, Ohio, and Maryland all having to reschedule their primary races.

Jonathan Turley is a constitutional law professor at George Washington University, and he said on Friday that gerrymandering blatant efforts by Democrats undermine their claims about Republicans being a threat to democracy.

Turley told Fox News’ “America’s Newsroom” hosts Bill Hemmer and Dana Perino that it is becoming “more and more difficult for the Democrats to run on this ‘Protect Democracy’ slogan when courts are saying that they’re trying to rig elections.”
