Pres. Biden suffers another coronavirus-related legal blow

The attorney general of Texas just handed the Biden administration another coronavirus-related legal defeat.

Fox News reports that a federal judge just halted coronavirus protocols put forth by the Biden administration as conditions for the funding of Head Start programs.

Back in November of 2021, the Biden administration implemented rules requiring Head Start program children, two years of age and up, to wear face masks. There were some exceptions, but parents dropping off or picking up their children also have to wear facemasks.

In addition to this, the U.S. Department of Health and Human Services (HHS) is requiring Head Start staff, contractors, and volunteers to get vaccinated against the coronavirus by the end of January.

Texas Attorney General Ken Paxton (R), along with 25 other states, have responded to these rules with a lawsuit. Paxton filed his lawsuit in the Northern District of Texas back on December 10th, arguing that such mandates are illegal.

“These unconstitutional mandates have no place in our country, and they are not welcomed here in Texas,” Paxton said.

Judge James “Wesley” Hendrix agreed.

This week, Hendrix issued an opinion stopping the Biden administration coronavirus mandates for Head Start.

“The agency’s rule requires Head Start staff to be vaccinated and near-universal masking of children and adults,” Hendrix wrote. “It is undisputed that an agency cannot act without congressional authorization. Thus, the question here is whether Congress authorized HHS to impose these requirements.”

Paxton celebrated the victory, saying, “This is a win for the children of Texas for sure, given that parents should be making these decisions, not the Biden administration.” Paxton added that he thinks “parents are going to be glad they get to make the decision. This is a victory for freedom in America.”

Texas Gov Gregg Abbott (R) also celebrated the ruling, writing, “Texas just beat Biden again. Another of Biden’s vaccine & mask mandates was just halted by a federal judge in Texas.”

Paxton expressed his hope that the Biden administration “will lay down their sword and stop jabbing at parents and kids and just let this thing stand.” But, he noted that it’s unlikely.
