President Biden’s refusal to uphold the immigration laws is a grave dereliction of duty and an insult to the sovereignty of the American people.
17 red states called out Biden’s betrayal to the nation in a legal brief blasting the administration’s catch and release policy, which has now allowed 1 million illegals into the country, Breitbart reported.
Red states call out Biden
The case, Texas v. United States, concerns Biden’s attempt to abolish ICE in everything but name by ordering agents to only target certain immigrants for arrest and deportation, leaving a huge number of illegals above the law.
On Biden’s watch, illegal immigration has continuously set records, with 240,000 border encounters recorded in May. That brings the total number of encounters in fiscal year 2022 to a staggering 1.5 million.
Those numbers do not account for the high volume of “got aways” who evade capture, the red states noted in their brief.
The Biden administration is unlawfully releasing many of those who are caught into the country by abusing “parole” authority that is meant to be used in very limited circumstances, the brief added.
The Department of Homeland Security has the discretion to parole certain illegals on a case-by-case basis, the Center for Immigration Studies reports, but Biden officials are releasing migrants “en masse.” In May alone, 68,527 aliens were paroled.
The administration recently announced in the case Biden V. Texas that the DHS released 95,318 migrants overall in May, bringing the total official number to over 1 million since Biden’s inauguration.
The 17 red states accused the Biden administration of engaging in a “cynical pattern of lawlessness” by failing to uphold the immigration laws.
“For the vast majority of migrants unlawfully entering the U.S., actual enforcement of U.S. immigration laws by DHS is thus the rare exception, rather than the rule,” the brief states.
The Biden administration’s radical policy curtailing ICE enforcement is currently on hold after a federal judge struck it down.
The Supreme Court ruled in Biden V. Texas that Biden could end President Trump’s “Remain in Mexico” policy. Biden is also trying to kill off the Trump administration’s Title 42 public health order, which if ended could lead to a historic explosion of migrants — 18,000 a day — storming the border.
