Report: Kamala Harris declined to prosecute gang member who was later convicted of murder

Before being elected as California’s junior senator, Kamala Harris served as San Francisco’s district attorney and later, as attorney general of California, roles that have come back to haunt her as she vies for the White House alongside Joe Biden. Hawaii Rep. Tulsi Gabbard (D) first brought up the issue of Harris’ record as a prosecutor during a Democratic presidential primary debate last year — and now, Harris has just been caught in a bind yet again.

In an article published Wednesday, Breitbart took readers back to the summer of 2008, when a 48-year-old California man and his two sons were murdered by Edwin Ramos, an undocumented immigrant who was said to be a member of the MS-13 gang.

The three victims and another member of their family were in their vehicle on their way home from a barbeque when Ramos opened fire after mistaking them for members of a rival gang, Breitbart reported. But it seems the whole situation could have been avoided.

According to Breitbart, Ramos “was arrested but went unprosecuted by then-San Francisco District Attorney Kamala Harris’ office months before he murdered [the] California family.”

Dropping the ball

In a report earlier this month, Breitbart noted that Harris ultimately refused to seek the death penalty for Ramos despite a request from family members of the victims that she do so. But that wasn’t the first time Harris pulled her punches when dealing with the killer, who was convicted and sentenced to three life sentences without the possibility of parole in 2012, according to SFGate.

“In March [2008], three months before the killings, Ramos was arrested in San Francisco after police pulled him over because his car had illegally tinted windows and no front license plate,” the San Francisco Chronicle reported just a month after the murders, according to Breitbart.

The Chronicle added: “An alleged gang member in the car tried to discard a gun, but police recovered it and later concluded that it had been used in a double killing, authorities said.”

Still, Harris’ office opted not to charge Ramos at the time, despite the fact that authorities knew about his affiliation with the gang and had “numerous documented contacts” with him, Breitbart noted.

Missing the mark

Harris also didn’t pursue deportation for Ramos, despite his status as an illegal alien. According to Breitbart, the Los Angeles Times reported in July 2008 that deportation proceedings were not initiated “because of an apparent mix-up between the federal Immigration, Customs and Enforcement Agency [ICE] and the San Francisco Sheriff’s Department, which runs the jail.”

ICE spokesman Tim Counts told a different story, though, telling the Times that his agency wasn’t contacted about Ramos until two hours before he was scheduled to be released, according to Breitbart.

Nowadays, Harris is supporting “a national sanctuary policy that would shield arrested illegal aliens from being turned over to” ICE, Breitbart reports.

Indeed, while the vice presidential hopeful may have a history of flip-flopping on key issues, it seems she’s stood steady when it comes to giving a pass to illegal immigrants. Why is it so hard for Dems to put Americans first?
