A new lawsuit out of Texas charges that President Joe Biden and his Department of Homeland Security have blocked border officials from doing their jobs amid a crisis that’s seen record numbers of migrants crossing into the United States.
According to Fox News, nearly half a dozen Texas sheriffs have joined with their local departments and a group that represents Immigration and Customs Enforcement (ICE) agents in a suit against the Biden administration that alleges federal law enforcement officials have been blocked from deporting migrants with criminal backgrounds.
The suit comes as some 930,000 undocumented migrants have been met by authorities at the border since January. Over 180,000 of them crossed the border in May alone, Fox said, and the number is only climbing.
“Turn them loose”
According to the Washington Examiner, the suit was first filed in federal court on Thursday. In their complaint, the plaintiffs charge that Biden “has enticed criminals to illegally immigrate to the United States, affecting local law enforcement operations and communities,” the Examiner reported.
The outlet spoke with Kris Kobach, the former Kansas secretary of state who is leading the plaintiffs’ legal team.
“The ICE officers involved in this case are absolutely astounded at what their superiors are asking them to do: releasing people charged with rape of a child, releasing people charged with dealing drugs and resisting arrest,” Kobach told the Examiner by phone.
“These are really serious criminals,” Kobach added, “and ICE is being ordered by the political leadership of the Biden administration to turn them loose.”
“An unbearable burden”
Under Biden’s latest policies, the plaintiffs say, local law enforcement officials who encounter criminal undocumented migrants must release them rather than turn them over to ICE, “where they would face deportation proceedings before a judge,” the Examiner explains.
It’s a policy that Kobach contends “stands in direct violation of not one, but three, different federal statutes.”
“Congress has mandated that the executive branch must detain and remove certain illegal aliens, but the Biden Administration is ignoring the law,” the lawyer said in a statement, as the Examiner reported.
Kobach went on: “The administration’s actions have forced ICE to stand down and have almost brought deportations to a halt. That has fueled the crisis at the border, encouraging more illegal immigration. It has also created an unbearable burden for local law enforcement in Texas.”
The suit was filed just a day after former President Donald Trump made a trip to the border to see the situation there for himself. Appearing alongside Texas Gov. Greg Abbott (R), the former president said that he oversaw “the best border we’ve ever had in the history of our country,” The Texas Tribune reported. Under Biden, Trump said, “we have an open, really dangerous border.”
