Republican Senate subpoenas for election equipment, materials can be enforced in Maricopa County, court rules

The Maricopa County Superior Court ruled Friday that subpoenas for election equipment and materials are “legal and enforceable,” paving the way for those items to be turned over to state Senate Republicans for yet another audit of votes in Arizona.

The county had asked the court to nullify the subpoenas, saying that it had already conducted several audits of the votes and that it would be illegal to give the Senate access to the ballots, the Arizona Mirror reported.

The court evidently disagreed and ruled that subpoenas could go forward.

“The Court finds that Subpoenas are legal and enforceable. There is no question that the Senators have the power to issue legislative subpoenas,” Judge Timothy Thomason said about the action, according to the Washington Examiner.

Subpoenas can be enforced

The court’s decision does not mean that the subpoenas will be enforced, but says that they can be.

“The Subpoenas comply with the statutory requirements for legislative subpoenas. The Senate also has broad constitutional power to oversee elections,” the court added.

One subpoena sought to collect the electronic ballot image that exists for all mail-in ballots counted in the county’s November 2020 general election. The second subpoena would require a full forensic audit of ballot tabulation equipment, related software, and the election management system used in the 2020 general election.

County board supervisors say they have already provided most of this information, other than the images of ballots and access to the machines.

Audits already conducted

An independent audit by the county was released Tuesday and showed that votes were correctly counted, the machines functioned properly, and the machines were not hacked or connected to the internet during the election.

The Senate wants voter information to be checked again and said it was not satisfied with existing efforts to audit and verify votes in the state.

Many Republicans believe that the 2020 election was conducted unfairly, and want assurances that votes were counted correctly amid numerous allegations of fraud.

No legal efforts or audits were able to find mistakes or errors that would have overturned any state election results, but allegations persist that the election was “stolen” by Democrats.

  2. It’s about time that the SCOTUS does something that will prove that Dominion has been used for some of the systemic fraud held in the Nov. Presidential election and Dominion be put in a spot. This may help the lawsuits that they have against the people who they are sueing for saying the fraud was just that.

    1. What I do not understand is why Biden got away with all the fraud that he told us he had set up before election. He said,”We have the most extensive fraud ever set up in U.S. history before election and he got away with it? He should be in jail and not the White House. I still have the picture of him saying that.

    2. Don’t worry about the law suits. They won’t go anywhere but out the door. I am with you, there was fraud and I still consider Trump my president. He has done more for this country than any other president in decades. It should be obvious about the fraud becuase it only happened in battle ground states. Trump won over two thirds of the country. I watched the election and saw that he was winning in those states but over night, the mail in ballots were dumped and suddenly he lost. There is no way that all those ballots could have been for Biden unless all of them were not mailed in. Some had to be just filled out at the time and put in as a mail in vote since they didn’t keep all the envelopes and compare them. We were not born yesterday and Biden could never have gotten more votes than Obama.

  4. Jovan Hutton Pulitzer gave a well-reasoned and thorough explanation of why all of the 2.1 million original ballots must be included in a forensic audit of Maricopa County’s November 3 election. He is getting resistance. Why is the judge putting up with this? Why doesn’t he specify a date by which ballots be turned over on penalty of arrest for failing to comply with a court order? Who’s running the show in Arizona? Are the citizens of Arizona “chopped liver”! Stop anyone on the street and ask those who voted in person with a valid ID if they mind that state officials are defying a court order directed toward finding out whether or not their vote was nullified by illegal voters.

  5. Way too late. This will drag on and on. When the SCOTUS refused to hear arguments and so the fraud election was allowed to be certified on Jan 6, the Constitution and rule of law became toilet paper.

    1. Why do so many people listen to her. She is a bar tender and she got where she is becuase of ding bats that liked her as a personality. Her ideas our so out rageous I have to laugh. Getting rid of cows, which have been here since before we were, and oil comes from the earth. It is a natural resource. She just says what ever comes to her mind and most of it is nonsense.

  6. The people will clean out our govt if they expose the fraud they have done to take over, therefore the truth must be kept hidden from the citizens.
