Republican Senator Ted Cruz (R-Tx.) joined Fox News to weigh in on the possible identity of the “woke little left-wing twit” who leaked the Supreme Court’s prospective opinion overturning Roe v. Wade.
Cruz told Jesse Waters Primetime that the leaker is probably a law clerk for one of the Court’s liberal justices, leaving about a dozen suspects, Fox News reported.
Cruz weighs in on leaker’s identity
The leaked draft opinion, authored by Justice Alito, says that Roe was “egregiously wrong from the start” and that it unconstitutionally prohibited the people from regulating abortion through their representatives.
Chief Justice John Roberts has opened an investigation into the “appalling” and unprecedented leak of the draft to Politico on Monday evening.
For his part, Cruz said that the “limited universe” of the Supreme Court narrows down the list of potential leakers to just a handful of people. He said there is “zero” chance a justice is behind the leak and that the perpetrator is probably one of 12 clerks for the Court’s three liberal justices.
Cruz said he is confident the leaker will be found and penalized with disbarment or prosecution, noting they probably left a paper trail with journalists.
“When they are found, they are going to be fired on the spot. They will be disbarred if they’re members of the bar, or they will never be admitted to the bar to be a lawyer, and to the extent that they have broken criminal laws, they need to be prosecuted and sent to jail.”
Liberals applaud attack on the Court
There has been much speculation that the person responsible is a clerk, likely educated at a woke Ivy League law school, who is attempting to intimidate the Court.
“I see it every day — young people at elite schools are very radicalized,” said Brian Fitzpatrick, a law professor at Vanderbilt University and former clerk for the late Justice Scalia.
Cruz blasted the leak as an attack on an independent branch of government, saying, “it is difficult to overstate how destructive it is” to the Court’s integrity.
Some have questioned whether Democrats had foreknowledge of the leak, which liberals have pounced on to gin up their base and paint Republicans as “extreme” before midterm elections that Democrats are expected to lose handily.
