Ken Paxton (R), the attorney general of Texas, just hit the Biden administration with another immigration-related lawsuit, the Daily Wire reports.
This particular lawsuit challenges changes that President Joe Biden and his administration are making to the asylum and parole procedures that take place at the U.S.-Mexico border.
The Department of Homeland Security (DHS) has put forth a new policy that would alter the processing system for those immigrants who say that they are fleeing their home countries due to a fear of persecution. The policy would make it so that these particular asylum cases would be handled by asylum officers rather than immigration judges.
The rule change is expected to go into effect on May 29 unless Paxton’s lawsuit is successful.
Paxton, in the lawsuit, alleges that the rule change is illegal.
“The Interim Rule transfers significant authority from immigration judges to asylum officers, grants those asylum officers significant additional authority, limits immigration-judge review to denials of applications, and upends the entire adjudicatory system to the benefit of aliens,” Paxton writes in the lawsuit.
Paxton has also released a statement explaining why he has decided to sue.
The statement reads:
I protested the proposed version of these rules back in October 2021, and, unsurprisingly, Biden found a way to make it worse, so I’m suing. The last thing Texas needs is for this Administration to make it easier for illegal aliens to enter the U.S. and obtain asylum through false claims and less oversight. We know what’s going to happen when the rule goes into effect in May 2022: wave upon wave of illegal aliens claiming “asylum.” It’s true that our immigration system is extremely backlogged. But the answer is to secure the border, not overwhelm it even more by enacting cheap, easy incentives for illegal aliens to get into the United States.
This lawsuit is the 11th immigration-related lawsuit that Paxton has filed against the Biden administration.
Just last week, Paxton joined the legal battle to stop the Biden administration from ending Title 42 expulsions. Title 42 is the Trump-era policy that has been used by the federal government to expel illegal immigrants during the coronavirus pandemic. A federal judge has now temporarily stopped the policy from coming to an end.
The concern with most of the immigration-related lawsuits that Paxton has brought against the Biden administration is that Biden’s new policies are going to make the southern border crisis even worse than it already is by further encouraging illegal immigration.
The Biden administration, for example, is predicting an increase of around 10,000 border-crossers per day should Title 42 come to an end.
