Texas is taking the Biden administration to court over its reckless decision to end the Title 42 immigration policy in the coming weeks.
Texas Attorney General Ken Paxton (R) warns that Biden’s move will create a “devastating flood” of illegal immigration, Fox reported.
Texas sues Biden over Title 42
Paxton noted the “arbitrary” discrepancy between Biden’s continued enforcement of mask and vaccine mandates for American citizens and his lax approach to controlling the border. Title 42 was enacted by President Trump as a public health policy at the outset of the COVID pandemic.
While Biden continues to police the personal medical decisions of Americans — including by trying to keep a mask mandate alive for interstate travel — he seem “not to be concerned at all” with the large numbers of people pouring across the southern border, Paxton told Fox.
“We’re … arguing that the change is arbitrary and capricious in light of the fact that everything else they’re doing is designed to restrict Americans,” he said.
His lawsuit calls Title 42, which allows migrants to be rapidly expelled without a chance to plead asylum, all that is “holding back a devastating flood of illegal immigration” and accuses Biden of ignoring the proper administrative process, which requires an opportunity for public comment.
Biden’s radical immigration agenda has hit occasional speed bumps in the courts. A judge granted a restraining order against Biden’s Title 42 decision Monday in response to a lawsuit from Louisiana, Missouri, and Arizona.
Biden’s border invasion
Title 42 was virtually the only border policy left from the Trump administration after Biden started opening up the southern border on day one of his presidency, leading to the highest illegal immigration rates ever recorded. In March, there were over 221,000 illegal migrant encounters.
Biden’s cancellation of the Title 42 policy promises to make an already unsustainable crisis dramatically worse: officials estimate that as many as 18,000 migrants per day, or roughly half a million per month, could start storming the border when the policy ends in May.
The legal fight over Title 42 coincides with a battle over Trump’s “Remain in Mexico” agreement, which Biden — in his audacious attempt to foment a border invasion seemingly on purpose — has sought to end for months. The Supreme Court will hear arguments on “Remain in Mexico” on Tuesday.
Echoing the feelings of many Americans, Paxton said that Biden is “basically spitting in the face of the American people” by refusing to execute his Constitutional duty to protect the nation’s borders.
“We already have a massive influx of illegals. This was the only thing left keeping it from being even worse,” Paxton told Fox.
