Trump judge strikes down Biden rules on ‘gender-affirming care’, transgender pronouns in the workplace

The Biden administration has aggressively pushed gender ideology on every area of public and private life, with a particular focus on young, vulnerable children.

In a setback to Biden’s radical agenda, a Trump judge has blocked a Biden rule protecting so-called “gender-affirming care” for children, as well as federal “guidance” that forced companies to use transgender pronouns, Conservative Brief reported.

The lawsuit was brought by Texas’ Republican attorney general Ken Paxton in response to Equal Employment Opportunity Commission (EEOC) guidance requiring employers to use transgender pronouns and allow transgender individuals to use bathrooms of their choice.

In his October 1 ruling, judge U.S. District Court Judge for the Northern District of Texas Matthew Kacsmaryk wrote that the Biden administration took an overly broad view of the Supreme Court’s controversial decision in Bostock v. Clayton County.

When it was decided, conservative critics said Bostock, which expanded civil rights law to cover gays and transgenders in the workplace, incorrectly read congressional intent into the Civil Rights Act of 1964 where none existed.

While not attacking Bostock directly, Kacsmaryk said that Biden officials had wrongly interpreted the ruling as a blanket protection for “correlated conduct.”

The judge cited Justice Gorsuch’s opinion in Bostock, in which Gorsuch said the court does “not purport to address bathrooms, locker rooms, or anything else of the kind,” but merely the question of whether companies can fire someone for being gay or transgender.

Affirming reality

Kacsmaryk also issued a reality-affirming decision on the controversial topic of “gender-affirming care,” the left’s Orwellian term for often irreversible sex change procedures performed on children suffering with gender dysphoria.

After Texas declared that it would begin treating such “care” like child abuse, the Biden administration responded with “guidance” that blocked federally funded entities from restricting it. Judge Kacsmaryk called the Biden administration’s response “arbitrary and capricious.”

Paxton called the judge’s ruling a victory for the rule of law and vulnerable children.

“The Biden Administration’s attempts to radicalize federal law to track its woke political beliefs are beyond dangerous. I will continue to push back against these unlawful attempts to use federal agencies to normalize extremist positions that put millions of Texans at risk,” he said.

The fight is far from over. California Gavin Newsom recently signed a shocking law that permits the kidnapping of a child in order to have the child’s sex changed.
