The FBI took many items during a raid on former President Donald Trump’s home earlier this month, including his passports. While the passports were later returned, the FBI still holds a large number of seized documents.
As CBS News reported on Saturday, Trump’s legal team is now considering whether to ask that a “special master” be appointed to review the things that were taken.
Trump’s attorney says the motion is “coming very soon”
According to Cornell Law School’s Legal Information Institute, “A ‘special master’ is appointed by a court to carry out some sort of action on its behalf.”
CBS News cited sources as saying that the special master could come into play should Trump’s legal team “seek relief under the Federal Rules of Criminal Procedure that govern searches.”
One of those provisions is Rule 41(g), which concerns the return of seized property. It states, “A person aggrieved by an unlawful search and seizure of property or by the deprivation of property may move for the property’s return.”
CBS News noted that Trump attorney Jim Trusty recently told conservative talk radio host Mark Levin that a motion requesting the appointment of a special master is “coming very soon.”
“We have privilege issues that are extremely important here,” Trusty was quoted as telling Levin. He went on to allege that the FBI’s search was “overbroad” and exceeded the “narrowness” required by law.
“We do think that one of the benefits of the special master, if the master agrees, is we can stop DOJ in their tracks when it comes to inspecting these documents,” Trusty continued.
Trump ties raid to midterm elections
The former president himself hinted in a post on Truth Social that a request for a special master will soon be forthcoming.
“A major motion pertaining to the Fourth Amendment will soon be filed concerning the illegal Break-In of my home, Mar-a-Lago, right before the ever important Mid-Term Elections,” he declared.
“My rights, together with the rights of all Americans, have been violated at a level rarely seen before in our Country. Remember, they even spied on my campaign,” Trump insisted.
“The greatest Witch Hunt in USA history has been going on for six years, with no consequences to the scammers. It should not be allowed to continue!”
