President Joe Biden just reversed another policy of the Trump administration.
Breitbart reports that Biden’s Department of Health and Human Services (HHS) has declared that sexual discrimination, in the area of health care, will go back to including discrimination on the basis of sexual orientation as well as gender identity.
Biden’s HHS made the announcement on Monday via its Office for Civil Rights (OCR).
“Today, the Department of Health and Human Services announced that the Office for Civil Rights will interpret and enforce Section 1557 and Title IX’s prohibitions on discrimination based on sex to include: (1) discrimination on the basis of sexual orientation; and (2) discrimination on the basis of gender identity,” the announcement reads.
HHS Secretary Xavier Becerra claims that his agency’s decision was based on a U.S. Supreme Court ruling, specifically Bostock v. Clayton.
“The Supreme Court has made clear that people have a right not to be discriminated against on the basis of sex and receive equal treatment under the law, no matter their gender identity or sexual orientation,” Bacerra said. “That’s why today HHS announced it will act on related reports of discrimination,” said HHS Secretary Xavier Becerra.
HHS Assistant Secretary Rach Levine, who is a transgender individual, added:
The mission of our Department is to enhance the health and well-being of all Americans, no matter their gender identity or sexual orientation. All people need access to healthcare services to fix a broken bone, protect their heart health, and screen for cancer risk. No one should be discriminated against when seeking medical services because of who they are.
As Fox News reports, former President Donald Trump, back in 2020, enacted a policy that restricted the definition of sex in health care sexual discrimination claims to one’s biological sex.
In doing so, Trump overturned the policy of his predecessor, Barack Obama, which was that one’s sex includes “one’s internal sense of gender, which may be male, female, neither, or a combination of male and female.” So, Biden’s HHS is essentially returning to Obama’s version of the rule.
One of the effects of this change is that hospitals and insurers will no longer be able to refuse certain services, such as abortions or gender transitions, as they were able to do under Trump’s version of the rule.
American Principles Project (APP) President Terry Schilling recently blasted the HHS’s announcement.
“Make no mistake,” he said, “the policy announced by HHS today is not about ‘fix[ing] a broken bone’ or ‘screen[ing] for cancer risk.’ No American was being denied access to these treatments for identifying as ‘LGBTQ.’ Rather, this policy is really about forcing hospitals and medical professionals to adhere to leftist ideology regarding sexuality and gender—and in particular to provide sex-change procedures to all comers, including children.”
