Speaker Pelosi and House Dems pass a new abortion bill

House Speaker Nancy Pelosi (D-CA) and her fellow Democrats just followed through on their promise to take action against Texas’s newest anti-abortion law.

Breitbart reports that on Friday the Democrat-led House of Representatives passed a bill that not only legalizes abortions but stops state governments from making abortions illegal. 

The bill passed the House by a tally of 218 to 211. All Republican members of the House voted against it.

The House Democrats are calling the bill the “Women’s Health Protection Act of 2021.” The purpose of the bill is “to protect a person’s ability to determine whether to continue or end a pregnancy, and to protect a health care provider’s ability to provide abortion services.”

Note that the Democrats didn’t say a “woman’s ability.” That’s because they write in the bill that the right to have an abortion is “critical to the health of every person capable of becoming pregnant,” including “transgender men, non-binary individuals, those who identify with a different gender, and others.”

The Democrats base their argument for the legality of abortion on “reproductive justice.”

The bill reads:

Reproductive justice requires every individual to have the right to make their own decisions about having children regardless of their circumstances and without interference and discrimination. Reproductive Justice is a human right that can and will be achieved when all people, regardless of actual or perceived race, color, national origin, immigration status, sex (including gender identity, sex stereotyping, or sexual orientation), age, or disability status have the economic, social, and political power and resources to define and make decisions about their bodies, health, sexuality, families, and communities in all areas of their lives, with dignity and self-determination.

Background

This comes following the enactment of Texas’s Heatbeat Act. This act makes it illegal to have an abortion once a fetal heartbeat can be detected, which is typically at about the six-week mark of the pregnancy.

The act went into effect earlier this month after surviving some preliminary legal challenges, including at the U.S. Supreme Court level. The act is not in the clear yet, though, as a Texas doctor has intentionally violated it in order to challenge its constitutionality.

Following the enactment of the Texas Heartbeat Act, Pelosi vowed to take legislative action, specifically by codifying Roe v. Wade, the infamous case in which the U.S. Supreme Court discovered in the Constitution something that many didn’t know was in there: a woman’s right to have an abortion.

It’s pretty clear that the “Women’s Health Protection Act of 2021” is Pelosi and the Democrats’ response to Texas’s Heartbeat Act. But, in case there is any doubt, Rep. Maxine Waters (D-CA) put out a statement saying to Texas Gov. Greg Abbott (R) “this one’s for you!”

It remains to be seen whether the Democrats’ new bill will make it through the U.S. Senate. It’s likely that it will not, but one can never say for sure these days.
