With their new-found power, Democrats call for court-packing

Now, that the Democrats have the presidency, the Senate, and the House of Representatives they are eyeing the U.S. Supreme Court.

Breitbart reports that Brian Fallon, a former spokesman for Hillary Clinton and the current executive director of the far-left group Demand Justice, is calling for Democrats to “reform” America’s courts. 

It’s coming

What Fallon is specifically calling for here is expansion.

President Donald Trump and Republicans have been diligent about filling vacancies in both the federal courts and in the Supreme Court. Fallon wants the Democrats to bypass this by expanding both the number of federal judges and the number of justices on the Supreme Court.

In terms of the Supreme Court, Fallon wants to see it expanded from nine justices to thirteen. This is the minimum number needed to overcome the High Court’s current conservative majority.

The expansion would create vacancies that the Democrats, who now control the government, would be able to fill unimpeded. Whether or not President-elect Joe Biden and the Democrats will go for court-packing remains unclear. Biden, prior to the 2020 election, initially avoided questions on court-packing before finally coming out against it.

Fallon is also calling upon current liberal Supreme Court Justice Stephen Breyer to step down so that Biden can replace Breyer with a younger progressive judge.

“Justice Breyer’s service on the court has been remarkable, and history will remember him even more fondly if he ends up playing a critical role in ensuring the appointment of the first Black woman to the court,” Fallon recently told Politico. “Timing his retirement in the coming year would guarantee that opportunity, and it would be wise to do so because the window may prove a narrow one,” Fallon added.

We do know that Biden, last year, revealed that he had already begun putting together a list of Black women he would consider nominating to the Supreme Court, should the opportunity present itself.

It is unclear, though, whether Breyer would be amenable to this idea. Just in December, Breyer said, “eventually I’ll retire, sure I will,” but he added that “it’s hard to know exactly when.”

Watch out

Now that Democrats control the executive and legislative branches, the judiciary, especially the U.S. Supreme Court, is their final frontier.

If they conquer that, then we really will have become the one-party government that political commentators have been warning us about.
