The New York Times reported earlier this month that an upside-down flag was flown outside Supreme Court Justice Samuel Alito's home in January of 2021, something he said was put up by his wife following insults from neighbors.

This led one prominent Democrat to demand that the justice be removed from cases involving former President Donald Trump.

"Appeal to Heaven" flag was used during the American Revolution

According to the Times, a Google Street View photo showed an "Appeal to Heaven" flag flying outside of Alito's summer home in Long Beach Island, New Jersey.

Featuring a white background and a green pine tree, the flag was carried by patriots during the American Revolutionary War.

It has since been embraced by some conservatives and was spotted alongside other flags at the January 6 riot on Capitol Hill.

As Breitbart noted, Connecticut Democratic Sen. Richard Blumenthal took aim at Alito's use of the flag during a Wednesday appearance on MSNBC's "All In."

"I wish I could say I was surprised, but I am not," Blumenthal told host Chris Hayes. "Because this political statement, make no mistake, this flag is a political statement. It is part of a pattern."

Blumenthal calls Alito "unfit" to serve

"This political statement is, in effect, support for Donald Trump for a religious strand of the Stop the Steel movement and for [a] theological vision of what America ought to be and how it ought to be governed," he insisted.

"Which is okay for Speaker Johnson to fly outside his office. He’s a politician. Supreme Court Justices are supposed to be above reproach and above politics," Blumenthal insisted.

The lawmaker declared that he is "sad, really sad and shocked to say that Justice Alito is rapidly showing himself to be unfit to serve on the United States Supreme Court."

"At a minimum he has to recuse himself from these cases coming before the court that will determine whether or not Trump is held accountable," Blumenthal stated.

Blumenthal: "No way" Alito can judge cases in involving Trump

This is far from the first time Blumenthal has lashed out at Alito, as the senator made similar comments over Alito's upside-down flag during a previous appearance on "All In."
