Supreme Court rejects Michael Cohen's lawsuit against Trump

Fox News reported that disgraced ex-lawyer Michael Cohen filed a lawsuit against former President Donald Trump along with former Attorney General Bill Barr and other government officials following his imprisonment for perjury.

However, Cohen's case was dealt a fatal blow on Monday when it was rejected by America's highest judicial body. 

Cohen claims his return to prison was retaliatory

At issue was the Bureau of Prison's decision to return Cohen to prison in 2020 despite him having previously been released on home confinement due to the COVID-19 pandemic.

Cohen alleged that this move was an act of retaliation made in response to the publication of his book titled, "Disloyal: A Memoir: The True Story of the Former Personal Attorney to President Donald J. Trump."

The book detailed his time working as Trump's personal attorney, a fact which Cohen said led his former client to seek retribution.

"Presidents are not kings," Cohen's petition read. "This case represents the principle that presidents and their subordinates can lock away critics of the executive without consequence."

"That cannot be the law in the country the Founders thought they created when they threw off the yoke of the monarch," it continued.

Appeals court ruled against Cohen

Fox News noted that U.S. Federal Court Judge Alvin K. Hellerstein initially ruled in Cohen's favor, stating, "The purpose of transferring Mr. Cohen from furlough and home confinement to jail is retaliatory."

"It's retaliatory because of his desire to exercise his First Amendment rights to publish a book and to discuss anything about the book or anything else he wants on social media and with others," Hellerstein added.

Yet the United States Court of Appeals for the Second Circuit later concluded that Cohen was once again released on home confinement and the law does not seem to provide for damages.

The Supreme Court refused to hear Cohen's appeal, a decision which was welcomed by Alina Habba, who serves as one of the former president's attorneys. and she welcomed the Supreme Court's decision.

Trump lawyer calls Cohen's case "frivolous and desperate"

"Michael Cohen has exhausted every avenue of his pathetic attempt to drag my client into court time and time again," Habba was quoted as saying in a statement provided to Fox News.

"As expected, the Supreme Court has correctly denied Michael Cohen's petition and he must finally abandon his frivolous and desperate claims," the lawyer went on to add.
