Pennsylvania sues Elon Musk's $1M-a-day voter sweepstakes in federal court

Elon Musk, the wealthiest man in the world, skipped a hearing in which a state judge let both sides air their grievances, so a prosecutor in Pennsylvania is taking their fight against Musk's $1 million-a-day voter lottery to federal court.

Although Judge Angelo Foglietta acknowledged that tech entrepreneur Musk should have been present at the court because he is named as a defendant in the lawsuit filed by Democratic District Attorney Larry Krasner, he chose not to immediately punish Musk, as Reuters reported.

Matthew Haverstick, Musk's attorney, stated that his client is too busy to "materialize" in the courtroom in the hours leading up to the scheduled hearing. Musk, who has been a massive backer of former President Donald Trump, is seen to have made a win for the former president's campaign with his raffle and court win.

Dispute About Appearance

Krasner's legal team disputed the idea that SpaceX's founder could not reach Philadelphia, which prompted the judge to swiftly respond.

“Counsel, he’s not going to get in a rocket ship and land on the building,” Foglietta replied.

Musk's political organization is responsible for the substantial donations to registered voters, with the objective of supporting Donald Trump's presidential campaign.

The Argument

After his attorneys contended that allegations of federal election interference were at issue, Foglietta suspended the state case until a decision was rendered in federal court.

The case was assigned to U.S. District Judge Gerald J. Pappert, a Republican who was previously the Pennsylvania attorney general and was appointed to the federal bench by President Barack Obama.

In the evening of Thursday, Krasner submitted a petition to remand the case to the state court in Philadelphia, which is governed by Democrats.

That court was the original location of the lawsuit filing from Monday, in which he accused Musk and his PAC of conducting a questionable lottery in the fraught period leading up to Tuesday's election.

From the Other Side

Four of the first twelve winners seemed to be from Pennsylvania, which Krasner's attorneys pointed out.

As has been well reported, this state may hold the key to the presidential race between Trump and Vice President Kamala Harris.

“Is it just a coincidence that this is the state that has the largest electoral votes? I don’t think so,” lawyer John Summers argued at the hearing Thursday morning.
