Hegseth lawyers demand file proving his innocence in sex assault case

Lawyers for President-elect Donald Trump are demanding a file they claim contains exculpatory evidence clearing his defense pick Peter Sesgeth from a sexual assault claim even after the police file on the allegations has been released.

Democrats have continued to question his nomination because of the allegations even though he was never charged with any crime.

Specifically, Hegseth's lawyers want to see a memorandum underpinning the file that says the woman who accused him also accused another man of sexual assault in a different jurisdiction, and that witnesses contradicted her story.

“As part of our investigation, we received credible information indicating that she may have made a similar false allegation against another man in the past and the DA may have relied upon this as part of their determination, in addition to other witnesses who contradicted her story,” Hegseth lawyer Tim Parlatore told The Post.

"Exempt from disclosure"

Elected district attorney Jeannine Pacioni of the Monterey County DA’s office declined on Friday to release the requested documents, saying that “[t]he records you request are exempt from disclosure.”

“Your request for memoranda contains the opinions, conclusions, impressions, legal research and/or legal theories of the handling attorney[s]. These constitute core work product and are exempt from disclosure under the Public Records Act,” Pacioni and her chief assistant Berkley Brannon said.

Parlatore has appealed the decision.

As part of Hegseth's confirmation process, the Senate could subpoena the document, but subpoenas take time and Senate Republicans may not want to slow down his confirmation in that way.

Democrats not letting it go

Meanwhile, Democrat attacks and insinuations continue.

“Remember that we’ve just fought over a decade of fights … and overhauled the military and its treatment of military sexual trauma,” Sen. Tammy Duckworth (D-IL) said in a CBS News interview Sunday.

“It’s frankly an insult and really troubling that Mr. Trump would nominate someone who has admitted that he’s paid off a victim who has claimed rape allegations against him.”

Rep. Mikie Sherrill (D-NJ) said Sunday on MSNBC that “as a former federal prosecutor, I can tell you that there’s a difference between not bringing charges and fully clearing someone — and he is in no way been fully cleared.”

Video footage from the bar where the accuser and Hegseth were drinking showed that he was very intoxicated but she did not seem to be intoxicated at all despite claims that things were "fuzzy" and she didn't remember going to his room.

The video seems to show her leading him toward the room instead of the other way around.
