Judge blocks Kilmar Abrego Garcia from being deported after another judge ordered his release

Fox News reported that a federal judge moved on Monday to block alleged MS-13 gang member and illegal migrant Kilmar Abrego Garcia from being deported to Uganda.

That development came less than a week after another judge ordered that Abrego Garcia be released from custody. 

Abrego Garcia faces murder, child pornography, and trafficking charges

According to Breitbart, Obama-appointed Magistrate Judge Barbara D. Holmes ruled on August 19 against a Department of Justice (DOJ) motion which requested that Abrego Garcia be held prior to his trial.

Abrego Garcia faces a slew of charges which stem from allegations that he solicited child pornography, participated in the murder of a rival gang member’s mother, as well as engaged in the trafficking of weapons, narcotics, and human beings.

The DOJ further maintains that Abrego Garcia routinely abused female trafficking victims, something which even alarmed his fellow human traffickers.

"Other co-conspirators were so concerned about the defendant’s abuse towards the undocumented alien females that they confronted him about it on multiple occasions and and told him to stop," the DOJ asserts.

Judge temporarily bars Abrego Garcia from being deported

NBC News reported that Abrego Garcia was taken back into custody on Friday after he checked in with ICE officials under the terms of his release.

Simon Sandoval-Moshenberg is Abrego Garcia's attorney, and as Fox News explained, he filed a motion on Monday asking that his client not be sent to Uganda.

Judge Paula Xinis is weighing the motion and made clear that the federal government is barred from removing Uganda until a decision has been reached.

"Your clients are absolutely forbidden at this juncture to remove Mr. Abrego Garcia from the continental United States," Xinis told Justice Department attorney Drew Ensign.

"I'm going to take it from you, as an officer of the court, and on behalf of your clients, that there is the fullest intent to abide by those orders," she stressed.

DHS slams Democrats for supporting Abrego Garcia

Meanwhile, Fox News noted on Monday who the Department of Homeland Security (DHS) has slammed Democrats for rallying in support of Abrego Garcia.

"Kilmar Abrego Garcia is not and will never be a Maryland Man – he is a criminal illegal alien from El Salvador and public safety threat," a DHS official told the network in a statement.

"It is insane that sanctuary politicians chose to glorify and stand with an MS-13 gang member over the safety of American citizens," the official declared.
