Judge bans ICE from making arrests at courthouse, says agents will themselves be arrested

ICE agents as well as their Chicago-area facilities have been regularly targeted by mobs of violent demonstrators in recent weeks.

That isn't President Donald Trump's only reason to be furious about the Windy City, as a Biden-appointed judge there just handed down a shocking order. 

Judge bans ICE from making arrests at courthouse

According to Breitbart, U.S. District Judge Jeffrey Cummings has moved to prohibit ICE personnel from making warrantless arrests at courthouses.

What's more, the federal judge further cautioned that ICE agents will themselves be subject to arrest if they contravene his order.

"The fair administration of justice requires that courts remain open and accessible, and that litigants and witnesses may appear without fear of civil arrest," Cummings wrote.

"One thing seems clear: ICE rousted American citizens from their apartments during the middle of the night and detained them — in zip ties no less — for far longer than the ‘brief’ period authorized by the operative regulation," he added.

DHS defense use of collateral arrests

Breitbart, noted how Cummings' order concerns "collateral arrests," which refer to instances in which ICE agents apprehend illegal migrants whom they happen to come across while searching for someone else.

CBS News reported that the Department of Homeland Security (DHS) has defended the practice of making collateral arrests, calling it "common sense."

DHS further said in a statement that the department intends to "comply with all lawful court orders and is addressing this matter with the court."

However, it went on to stress that the United States is not "some medieval kingdom; there are no legal sanctuaries where you can hide and avoid the consequences for breaking the law," adding, "Nothing in the Constitution prohibits arresting a lawbreaker where you find them."

Chicago mayor declares "ICE-free zones"

Cummings' declaration came in the wake of an executive order from Chicago Democratic Mayor Brandon Johnson which designated certain areas of the city as being "ICE-free zones."

As Mediaite noted, the order was signed on October 6 and it bars ICE agents from making use of any "city-owned or controlled parking lots, vacant lots, and garages as staging areas, processing locations, or operations bases."

"We have a rogue, reckless group of heavily armed, masked individuals roaming throughout our city that are not accountable to the people of Chicago," Johnson was quoted as telling reporters at a press conference.

The Democratic official then went on to warn Trump that "[i]f Congress won’t check this administration, then Chicago will."
