Trump judicial nominee Eric Tung confirmed by Senate to serve on Ninth Circuit Court of Appeals

Thanks to the intransigent opposition of Democrats, the Senate confirmation process for President Donald Trump's administrative and judicial nominees has generally been rather slow-going.

On Wednesday, however, in a 52-45 vote, Senate Republicans confirmed Eric Tung to serve as a federal judge on the California-based Ninth Circuit Court of Appeals, according to Reuters.

That confirmation came despite fierce resistance and strong objections from some Democratic senators against the nominee's conservative-leaning beliefs and associations.

Nominated by Trump in July

Newly confirmed Judge Tung was first nominated by President Trump in July, who wrote in a Truth Social post, "I am very pleased to announce the nomination of Eric Tung to serve as Judge on the United States Court of Appeals for the Ninth Circuit."

"Eric worked for two of our Country’s Greatest Supreme Court Justices, Antonin Scalia and Neil Gorsuch, before working at the Department of Justice, and serving as an Assistant U.S. Attorney for the Central District of California," he continued.

"Eric is a Tough Patriot, who will uphold the Rule of Law in the most RADICAL, Leftist States like California, Oregon, and Washington," the president added. "It is critical now, more than ever before, that we have LAW AND ORDER. Good luck and congratulations Eric!"

Endorsed by Sen. Grassley

Before Tung's confirmation on Wednesday, Senate Judiciary Committee Chairman Chuck Grassley (R-IA) gave the nominee a ringing endorsement in a floor speech on Monday, in which he was described as a "great selection" to fill a vacancy on the liberal-leaning Ninth Circuit Court.

The senator observed that Tung graduated from Yale University and the University of Chicago School of Law, as well as that he'd clerked for the late Supreme Court Justice Antonin Scalia, along with Justice Neil Gorsuch, both on the nation's highest court and during his earlier service on the Tenth Circuit Court of Appeals.

Grassley further noted that Tung had experience working in the federal Solicitor General's office, as an assistant U.S. attorney in California, and as a "standout appellate lawyer" in private practice and civil litigation at the prestigious Jones Day firm, among other "stellar credentials and reputation."

All of that and more led the senator to express his belief that "Mr. Tung will make a phenomenal judge and serve this nation honorably and with distinction."

Another conservative judge on the liberal-leaning court

Reuters noted that the Ninth Circuit Court, once a liberal-dominated collection of judges, has now nearly reached partisan parity, thanks to President Trump and the 11 conservative-leaning judges he has appointed to it thus far over his two terms in office, bringing the balance to 16 Democratic appointees versus 13 Republican appointees.

Tung's conservative bona fides have been vouched for by the Federalist Society, of which he is a member, and evidence suggests that he will strongly support the Second Amendment and gun rights, as evidenced by a Guns.com report highlighting his five-year membership in the International Defensive Pistol Association, a competitive shooting organization.

Of course, the new judge's conservative leanings were deemed unacceptable by Democratic senators, including Sen. Alex Padilla (D-CA), who took particular issue with a Yale student newspaper article Tung wrote more than two decades ago, in which he criticized "radical feminists" and the work those and other leftist activists were doing to "blur gender roles" and generally "undermine institutions like marriage."

With Republicans holding the Senate majority, however, the staunch opposition from Democrats didn't matter, and the relatively young Tung will be seated on the Ninth Circuit appellate court for, hopefully, decades to come.
