Biden admin considers possible 'public health emergency' declaration to protect abortion rights

In response to pressure from abortion advocates and Democratic lawmakers, President Joe Biden's administration is considering issuing an abortion-related public health emergency declaration, Breitbart reported.

The pressure campaign from the aforementioned groups stems from their outrage over the Supreme Court's Dobbs decision in 2022 that overruled the Roe v. Wade precedent and returned the right to regulate abortions to individual states.

Emergency declaration under consideration

According to Axios, Health and Human Services Sec. Xavier Becerra revealed on Monday that "There are discussions on a wide range of measures ... that we can take to try to protect people's rights."

"There are certain criteria that you look for to be able to declare a public health emergency," he said. "That's typically done by scientists and those that are professionals in those fields who will tell us whether we are in a state of emergency and based on that, I have the ability to make a declaration."

Becerra added that there has not yet been a "full assessment" on what, exactly, such a declaration would entail or if it was even warranted but that "an evaluation" was ongoing.

A spokesperson for HHS further clarified to Axios, "We are constantly exploring additional actions we can take to protect and expand access to reproductive health care, including abortion care, and are prioritizing the actions that can give us the highest impact and most durable solutions."

Democrats demand emergency declaration

It was in July 2022 that a group of House Democrats sent a letter to President Biden and Sec. Becerra to "respectfully urge" them to declare both a national emergency and public health emergency related to abortion access following the Supreme Court's Dobbs ruling, which they deemed to be "radical and dangerous."

That ruling "precipitated a full-scale reproductive health crisis across our nation" and "plunged our health system into a state of uncertainty and upheaval that threatens patients’ lives," among other purported risks and threats that necessitated federal intervention.

The Democratic lawmakers specifically asked the Biden administration to deploy Public Health Services Corps teams, allow for more flexibility in Medicaid State Plan Amendments for pro-abortion "safe-haven" states, and to authorize and "accelerate access to" new abortion medications.

"We respectfully urge you to quickly issue a National Emergency and Public Health Emergency declaration and use your authority under the PREP Act to protect abortion access," the group of House Democrats concluded.

Democrats "love" abortion

Meanwhile, to display their complete support for the procedures that end the life of an unborn baby, at least two Democrats wore special pro-abortion pins to President Biden's State of the Union address on Tuesday, according to Life News.

Both Sen. Ed Markey (D-MA) and Rep. Madeleine Dean (D-PA) proudly showed on social media how they wore gold "Abortion" pins, in which the first "O" was a stylized heart, that had been gifted to them and others from the Planned Parenthood corporate abortion providers.

The pins were meant to also signify support for a Democratic-led legislative effort to go beyond simply codifying Roe, as Biden called on Congress to do during his speech, and actually expand abortion rights even further than before.

Dubbed by the National Right to Life organization as the "Abortion Without Limits Until Birth Act," the so-called "Women's Health Protection Act" would essentially federalize abortion rights and override virtually all state-level restrictions on abortion procedures, including time limits, waiting periods, information about alternatives, sex selection, conscientious objections, and taxpayer funding, among other things.
