CA Gov. Newsom signs order reaffirming gas car ban

California Gov. Gavin Newsom (D) just signed a measure that reaffirms his state's ban on gasoline-powered cars. 

Just the News reports that Newsom signed the measure on Thursday.

This comes as President Donald Trump continues to clash heads regarding the riots that have taken place in Los Angeles. But, it also comes after Trump signed a measure that essentially overturned Newsom's original gasoline-powered car ban.

In case you missed it, it was just recently that Trump signed a congressional resolution that overturns California's gas-powered car ban.

The Hill reported:

President Trump moved to overturn California’s electric vehicle (EV) mandate Thursday, setting off another legal fight with the Golden State. Trump signed a congressional resolution that overturns a California state rule that would have phased out the sale of new gas-powered cars by 2035. The California rule and the decision to revoke it are a massive deal for the auto market.

The mechanism that Congress used to take this action is the Congressional Review Act (CRA). The Hill explains that it "gives Congress, with presidential approval, the right to rescind recently passed regulations." This is exactly what Congress and Trump did.

The move was a big blow to Newsom, who vowed to fight the measure in the courts.

In addition to that, now he is trying to keep the ban in place by signing an order reaffirming the ban.

The latest

Newsom, now, has essentially ordered California to disregard Trump and Congress's congressional resolution and to proceed with the gas-powered car ban.

Newsom said:

We won’t let this illegal action by Trump and Republicans in the pockets of polluters stand in the way of commonsense policy to clean our air, protect the health of our kids and compete on the global stage. I’m signing an executive order to keep California on track with our world-leading transition to cleaner cars.

At the time of this writing, neither Trump nor his administration has responded to Newsom's act.

Now, though, the Trump administration has to deal with this new order as well as the lawsuit against the congressional resolution.

We'll have to see how this all plays out. The legal battle should help to flesh out federal versus state power boundaries on such issues.
