Criminal referral made against Democrat Rep. Eric Swalwell amid mortgage fraud claims
Numerous Democrats have attempted to use a weaponized justice system in an effort to take down President Donald Trump over the years, and now some of those self-declared partisan enemies are getting just a small taste of their own medicine in return.
Rep. Eric Swalwell (D-CA), one of Trump's most fervent and outspoken critics in Congress, has reportedly been referred to the Justice Department for a criminal investigation into allegations of mortgage and tax fraud, according to the Daily Caller.
The criminal referral came from Bill Pulte, the director of the Federal Housing Finance Agency, who has raised similar mortgage fraud allegations against other avowed Trump enemies like Sen. Adam Schiff (D-CA), New York Attorney General Letitia James, and Federal Reserve Governor Lisa Cook.
Criminal referral sent
NBC News, citing an anonymous source, was among the first to report that FHFA Director Pulte sent a referral letter on Wednesday to Attorney General Pam Bondi to recommend that she open a criminal investigation into alleged mortgage and tax fraud by Rep. Swalwell.
It is alleged that Swalwell made false or misleading statements on the loan documents for the multi-million-dollar home the California congressman purchased in the Washington, D.C., area.
The letter suggested that an investigation could uncover evidence of fraud involving the mortgage, local and state taxes, and homeowners insurance, among other possible crimes.
In addition to the letter sent to Bondi to urge the opening of a criminal investigation, the source indicated that Pulte also sent a referral letter to the FHFA's acting inspector general to recommend the opening of an internal probe of the matter.
Swalwell remains defiant
Rep. Swalwell, in response to the news that he'd been referred for a criminal investigation, expressed his defiance toward President Trump and complete lack of surprise at becoming the target of a probe in a statement he released to the public.
"As the most vocal critic of Donald Trump over the last decade and as the only person who still has a surviving lawsuit against him, the only thing I am surprised about is that it took him this long to come after me," Swalwell said.
"Like James Comey and John Bolton, Adam Schiff and Lisa Cook, Letitia James and the dozens more to come -- I refuse to live in fear in what was once the freest country in the world," he continued. "Of course, I will not end my lawsuit against him. And I will not stop speaking out against the President and speaking up for Californians."
"As Mark Twain said, 'Patriotism is supporting your country all the time, and your government when it deserves it,'" the congressman added. "Mr. President, do better. Be Better."
"No one is above the law"
It does not appear that Pulte has commented publicly about the criminal referral against Rep. Swalwell, though he did perhaps give a vague and trolling indication of what was to come about a week ago in a pair of X posts.
In the first post, Pulte borrowed an oft-used catchphrase of anti-Trump Democrats like Swalwell, "No one is above the law," and followed that less than an hour later with a second post that said, "Mortgage fraud is a serious crime and must be stopped at all costs."
NBC News noted that the Justice Department did not respond to requests for comment, and it remains unclear at this point if Pulte's referral letter will result in a criminal investigation, much less any potential criminal charges against the Democrat congressman.
