DOJ announces it will not help defend Trump in second E. Jean Carroll lawsuit

Author E. Jean Carroll filed her second defamation suit against former President Donald Trump last month, this time seeking $10 million in damages.

What's more, NBC News reported this week that the Department of Justice (DOJ) won't help Trump deal with his accuser. 

DOJ reverses its position

The network cited a court filing put forward on Tuesday in which the DOJ said "there is no longer a sufficient basis to conclude that the former President was motivated by 'more than an insignificant' desire to serve the United States Government" when he spoke about Carroll.

Carroll filed a lawsuit against Trump in 2019, accusing him of luring her into a New York City department store dressing room and then raping her roughly three decades ago.

What's more, the writer also asserted that the president defamed her when he dismissed her allegations as being a "hoax."

While a jury did not agree that Carroll had been raped, it did conclude that she had been sexually assaulted and was the victim of defamation, awarding her $5 million in damages.

Former attorney general argued Trump was covered by Westfall Act

Trump addressed the verdict in May CNN town hall event, calling Carroll a "whack job" and denying any assault to place. For her part, Carroll responded by filing another lawsuit.

NBC News noted that then-Attorney General William Barr found Trump was entitled to assistance from the DOJ in mounting a defense.

He pointed to the Westfall Act, under which federal employees enjoy absolute immunity from lawsuits stemming due to actions committed "in the course of their official duties."

Trump: "The statements that I made about Carroll are all true"

However, the DOJ has since rejected that conclusion, resulting in an angry denunciation from the former president on Wednesday.

"The DOJ will not defend me in the E. Jean Carroll civil case, which is all part of the political Witch Hunt, lawyered up by apolitical operative who I just beat in another case, financed by a big political funder, and 'judged' by a Clinton appointee who truly hates 'TRUMP,'" CNBC quoted Trump as saying in Truth Social post.

"The Carroll civil case against me is a Miscarriage of Justice and a total Scam," the 2024 Republican Party frontrunner went on to insist.

What's more, Trump doubled down on his denial of wrongdoing, saying, "The statements that I made about Carroll are all true."
