Federal judge blocks detention of student protester Trump admin. seeking to deport

A federal judge has once again blocked a move by the Trump administration, this time ruling that student protester Yunseo Chung cannot be detained by ICE after she was arrested during a protest at Columbia University.

The Trump administration is seeking to deport Chung due to her Hamas sympathies, but Manhattan federal court Judge Naomi Reice Buchwald said she can't be detained pending a hearing.

“I don’t think there is any evidence in the record that she would be a danger to the community,” Buchwald said during the hearing.

“The notion of putting this 21-year-old, who nothing in the record suggests is a danger … into ICE detention … is not a particularly appealing result,” the judge said.

Residency status questioned

Chung's lawyer claimed that she is a permanent resident; her family emigrated from South Korea when she was seven.

"No matter what [Secretary of State] Marco Rubio says, she remains a permanent resident,” Ramzi Kassem said.

But DHS spokeswoman Tricia McLaughlin said Chung must face a judge to decide whether she stays or goes.

“Yunseo Chung has engaged in concerning conduct, including when she was arrested by NYPD during a pro-Hamas protest at Barnard College,” McLaughlin said in a statement.

“She is being sought for removal proceedings under the immigration laws,” she added.”Chung will have an opportunity to present her case before an immigration judge.”

The game plan

It seems like the left has figured out how to stymie the Trump administration's efforts to restore law and order to the immigration system, particularly by deporting criminals and troublemakers.

All they have to do is find a liberal enough judge who hates President Donald Trump, and they can get a favorable ruling that prevents any action from taking place.

Trump has had 15 nationwide injunctions against his executive orders since taking office only two months ago; that's more than the 14 President Joe Biden had in his entire four years in office.

Obviously, the judicial branch is the only power the Democrats have right now, and they are bound and determined to use it to their maximum advantage.

Trump's next move will be to get the Supreme Court to rule against nationwide injunctions so he can use the power the people have given him.
