Florida Supreme Court suspends judge over jokes made from the bench
Earlier this week, the Florida Supreme Court moved to indefinitely suspend a lower court judge over comments that he made from the bench.
According to the Florida Phoenix, members of the state's highest judicial body took issue with a series of jokes told by Broward County Circuit Judge Gary Farmer, a Democrat who previously served as state Senate minority leader.
Judge joked that defendant should "wear a condom at all times"
His suspension came following an investigation carried out by Florida’s Judicial Qualifications Commission, which concluded last month that Farmer exhibited "unfitness to serve."
"Through his extensive misconduct, occurring over a lengthy period of time, Judge Farmer has damaged the public’s perception of the judiciary and the judicial branch in such a way that he has demonstrated a present unfitness to serve," the 13-page report declared.
In one instance, Farmer made light of a criminal defendant who was expecting three children by three different women.
"You were just shooting all over the place! That’s good, do you know their names? First and last? Romantic are you? Don’t tell Susie about Jane, don’t tell Jane about Mary. God bless you man. One’s enough," the judge stated.
Farmer later went on to add, "I’m going to order that you wear a condom at all times. For your own good. Ok?! Probation is going to check. No, I’m kidding. I’m kidding."
Farmer's lawyers deny that justice was "impaired or undermined"
What's more, the Judicial Qualifications Commission accused Farmer of "prejudging the outcomes of future cases, not yet before him."
The Phoenix noted how Farmer's attorney's submitted a response which argued that "the rendition of justice" had not been "impaired or undermined."
They maintained that "no urgent grounds or genuine exigent circumstances that warrant or require suspension of respondent pending trial or other final outcome of these matters."
"Indeed, Respondent has reflected on his comments and learned lessons. He has been striving to exhibit the highest level of professional conduct," Farmer's lawyers insisted.
Judge told "dad jokes" to " lessen the tension in the courtroom"
"While some of the comments or jokes made by Respondent were distasteful, no one other than anonymous prosecutors has filed any complaint in any form against Respondent," they continued.
The attorneys maintained that Farmer often made "dad jokes" in order "to lighten the atmosphere and lessen the tension in the courtroom."
They included saying, "I called the incontinence hotline. They told me to hold." Farmer also remarked, "Spring is here, I got so excited I wet my plants."
