Former DOJ official says DOJ is violating the rules with its Trump indictments

A former U.S. Department of Justice (DOJ) official says that President Joe Biden's DOJ - with its indictments of former President Donald Trump - is "flagrantly" violating its own "Justice Manual."

The man who made this claim is Gene Hamilton.

Background

During the Trump administration, Hamilton was the counselor to the U.S. Attorney General. Currently, he is the vice president and general counsel of America First Legal.

Hamilton, on Friday, participated in a panel discussion, hosted by the Heritage Foundation. The panel considered whether "the Justice System [is] rigged [against Trump]?"

Many have come to believe that the Department of Justice, federal law enforcement agencies, and some state prosecutors are operating a rigged system of justice, and that the Trump indictments are the clearest example of this. Join us as we discuss if the justice system is rigged and what can be done about it if so.

It was during this panel that Hamilton made his claim about Biden's DOJ - that it is "flagrantly" violating its own "Justice Manual."

The timing of the cases explains it all

Breitbart News managed to catch Hamilton's argument.

The outlet reports, "Particularly, Hamilton pointed to the timing of the federal indictments and trials brought against Trump, contending they breach the clause that pertains to 'initiating and declining charges.'"

Hamilton, according to Breitbart, pointed specifically to the timing of the cases - both the timing of the bringing of the indictments and the timing of the trials.

The documents case is scheduled to begin on May 20, 2024 - during the Republican presidential primary race - while the 2020 election interference case is set for March 4, 2024 - which is just ahead of Super Tuesday.

A "flagrant" violation of the DOJ's rules

Hamilton argued:

Now, I’m sorry, but if you look at the timing of these indictments and you look at the timing of what they’re trying to do with the trial, and how they’re scheduling things in these cases, the Department of Justice is violating its very own policies flagrantly.

Hamilton went on to argue that the American people "see right through" what Biden's DOJ is up to here.

What is Biden's DOJ up to? Hamilton said, "[E]verybody knows that [the DOJ's indictments of Trump are] being done for political purposes, each of the indictments, especially the federal ones."

At this point, there can be very little doubt about this. Hamilton's analysis of the entire situation is spot on.
