Former US solicitor general predicts another Trump indictment

 April 15, 2023

Neal Katyal, the former acting U.S. solicitor general, just predicted that former President Donald Trump will be indicted by the U.S. Department of Justice (DOJ) in relation to the classified documents situation.

Katyal, according to Mediaite, made the prediction during an appearance Friday on MSNBC's The Beat.

The classified documents situation is the same one that culminated in the unprecedented raid on Trump's Mar-a-Lago residence in August. This is part of the investigation that DOJ Special Counsel Jack Smith is leading into Trump.

"He will be indicted for it"

During his MSNBC appearance, Katyal argued that the classified documents situation is "the biggest threat" to Trump.

There, Katyal said:

I can tell you, having served as national security adviser at the Justice Department, nobody gets to take classified material home and other sensitive information or maps that was just recently revealed in the newspaper, that Trump was showing classified maps to people that didn’t have clearance after he was president. Nobody gets to do that and stay a free person. And certainly, nobody gets to do that after they’ve been asked to turn over those documents and don’t turn over those documents.

Accordingly, Katyal called this a "very, very serious problem for Trump," and he predicted that Trump "will be indicted for it."

What about Biden?

Katyal was not asked about the classified documents situation involving President Joe Biden. And, it is hard to understand how the DOJ would be able to move forward with such a case against Trump while not also bringing such a case against Biden.

Trump, himself, has made this point several times, arguing that there appears to be an obvious two-tier justice system at play here.

Trump, on Thursday, wrote, "Biden Obstructed with thousands of boxes loaded up with Classified documents, many stored in Chinatown, and you hear NOTHING about it. Why?"

Trump followed that up with another message, on Saturday, writing:

True, Biden is guilty of obstruction, 1,850 Boxes unchecked, many found in Chinatown, heavy on Classified Documents. He has been totally uncooperative, won’t show “Docs.” I went by the Presidential Records Act, have right to declassify, and did nothing wrong, but was purposely given, by DOJ & Biden, a Trump HATING Lunatic Prosecutor, Jack “Warthog” Smith, who is a harasser and abuser, in order to Obstruct & Interfere with the 2020 Presidential Election! Public won’t stand for unequal treatment!

A case of clear interference

Manhattan District Attorney Alvin Bragg (D) has faced serious criticism for bringing what appears to be a dubious indictment against Trump in New York.

Many have convincingly argued that, considering the weakness of Bragg's case and considering that Trump is the Republican Party's 2024 frontrunner, this appears to be a clear case of election interference.

Imagine, now, if the DOJ were to bring this classified documents case against Trump. It would be hard for the DOJ to escape the appearance of political persecution - of taking down Biden's top 2024 rival.

There is no question that the Biden DOJ wants to do it - rather the question is whether the DOJ believes the American people will allow them to get away with it. We'll see.
