Judge blocks 'Big Beautiful Bill' provision which strips funding from Planned Parenthood
Included in the "Big Beautiful Bill" that President Donald Trump signed last week was a provision to defund Planned Parenthood, America's largest abortion chain.
However, pro-life advocates were blindsided on Monday when an Obama-appointed judge put a pause on that change.
Judge: HHS must "ensure that Medicaid funding continues to be disbursed"
According to Fox News, U.S. District Judge Indira Talwani issued a temporary restraining order which prohibits the White House from withholding funds to Planned Parenthood.
As Breitbart reported, Talwani instructed the Department of Health and Human Services (HHS) to "take all steps necessary to ensure that Medicaid funding continues to be disbursed."
That order came after the policy was challenged in court by Planned Parenthood Federation of America, the Planned Parenthood League of Massachusetts and Planned Parenthood Association of Utah.
"The prohibition specifically targets Planned Parenthood Federation of America and its member health care providers in order to punish them for lawful activity, namely advocating for and providing legal abortion access wholly outside the Medicaid program and without using any federal funds," the plaintiff's lawsuit was quoted as stating.
Planned Parenthood official vows to fight on
Dominique Lee serves as president and CEO of Planned Parenthood League of Massachusetts, and she issued a statement following Talwani's ruling.
"The Trump administration’s hell-bent ambitions to close our clinics and abandon our patients won’t stop us," Lee declared.
"Let me be crystal clear: We are not intimidated," the abortion advocate insisted before asserting, "We were built for this moment,"
"Here in Massachusetts, we fight back, and we will never be bullied into turning our backs on health care or human rights," she went on to add.
Sen. Mike Lee suggests that Talwani should be impeached
Meanwhile, Fox News noted that Talwani's order was met with derision from conservatives, including Heritage Foundation senior legal fellow Tom Jipping.
"What you have here is Congress exercising its explicit constitutional authority to make spending decisions, and you have a district judge arguably trying to exercise power she doesn't have to force Congress to change," Jipping told Fox News.
"I don't know how fast that judge reads, but she issued her [temporary restraining order] within a couple of hours. That makes her court look like a fast food drive-through," he complained.
For his part, Utah Republican Sen. Mike Lee suggested that Talwani should be impeached and denounced her ruling as an "egregious judicial usurpation of legislative power."
