Judge rejects request from Philadelphia DA to issue an injunction against Elon Musk's PAC

Social media mogul Elon Musk has spent much of the past few months vigorously campaigning on behalf of former President Donald Trump.

However, one Democratic district attorney recently accused the billionaire entrepreneur of running an "illegal" election-related "scam."

"Ongoing criminal investigation" of Musk's political action committee

According to CNBC, that accusation was put forward in court on Monday by Philadelphia District Attorney Larry Krasner.

At issue is the fact that Musk's America PAC has been offering those who sign a petition supporting the Constitution a chance to win $1 million.

The organization has thus far distributed a total of $17 million to Pennsylvania residents, with the final payment being handed out on Tuesday.

"They know what they're doing is illegal, and they are doing everything under the sun to clean it up," Krasner was quoted as saying of the group's activities. He added that his office is carrying out an "ongoing criminal investigation."

Judge promises to provide an explanation of his ruling at a later date

"There is no First Amendment right to commit crimes," the district attorney declared before adding, "There is no First Amendment right to commit fraud."

Krasner had asked Philadelphia County Common Pleas Court Judge Angelo Foglietta to issue an injunction against America PAC that would prevent it from giving out any additional funds.

Yet as CNBC pointed out, Foglietta declined Krasner's request. While the judge did not provide any explanation for his ruling, he did say that more information would be provided at a later date.

While Krasner is a Democrat, he vehemently denied that party affiliation played any role in his decision to go after Musk's political action committee.

Former America PAC treasurer says Krasner's actions are politically motivated

Meanwhile, Krasner's claim was dismissed by former America PAC treasurer Chris Gober when he spoke with reporters outside the court.

"We're in court today because some district attorney in Philadelphia wants to silence Elon Musk for supporting Donald Trump," Gober told the journalists.

"Let me be clear about one thing. No district attorney, no prosecutor, I don't care how powerful they are, can take away the First Amendment freedoms that are the bedrock of this nation," the political activist went on to assert.
