Judge rules that Rep. McIver must stand trial for alleged assault on a federal officer

A judge just ruled that U.S. Rep. LaMonica McIver (D-NJ) must stand trial for the alleged assault that she committed on a federal law enforcement officer.ย 

Breitbart News reports that U.S. District Judge Jamel Semper issued the ruling on Thursday.

The ruling was in response to a motion from McIver asking for some of the charges that she is facing to be dropped.

Background

This all goes back to the incident that occurred back in May 2025.

Breitbart reports:

The incident spurring the charges occurred on May 9 when Reps. McIver, Bonnie Watson Coleman (D-NJ), Robert Menendez (D-NJ), and Newark Mayor Ras Baraka (D) showed up at Delaney Hall to โ€œconduct federal oversightโ€ of the facility and allegedly stormed in and trespassed. Baraka ended up beingย arrestedย on a criminal trespass charge.

It was not long thereafter that the U.S. Department of Justice (DOJ) decided to bring charges against McIver.

The charges were for assaulting, resisting, and impeding officers during a riot.

At the time, Department of Homeland Security Secretary Kristi Noem stated:

After a thorough review of the video footage of Delaney Hall and a full investigation from HSI, the U.S. Attorney for the District of New Jersey has made the determination to charge Congresswoman LaMonica McIver for assaulting, resisting, and impeding law enforcement officers. No one is above the law. If any person, regardless of political party, influence or status, assaults a law enforcement officer as we witnessed Congresswoman McIver do, you will be prosecuted to the fullest extent of the law. We thank our brave ICE law enforcement officers for their service to this great nation.

Motion denied

McIver has been attempting to fight back against the charges in court, arguing that the charges were unfounded and politically motivated.

McIver, though, has not had much success with her arguments.

Bloomberg News reports:

US District Judge Jamel Semper denied the Democratic lawmakerโ€™s motion to dismiss two of the three charges against her, rejecting arguments that she was selectively or vindictively prosecuted, and that she is protected by legislative immunity.

In other words, it is looking more and more likely that McIver is going to have to defend herself against these charges in court.

It is unclear, at the time of this writing, whether or not a trial date has been set.
